NOTICE IS HEREBY GIVEN, That application is intended to be made to Parliament in the next Session by the London and North Western Railway Com- pany (hereinafter called "the Company") for an Act for the following purposes, or some of them, (that is to Bay) To empower the Company to make and maintain the Railways following, or some or one of them, with all proper stations, sidings, approaches, works, and conveniences con- nected therewith (that is to say) Four Railways (to be called the Merthyr Extension Railways") (that is to say): Railway No. 1, to be wholly situate in the parish of Merthyr Tydfil in the county of Glamorg-m, com- mencing by a junction with the Dowlais Exten- sion Railway of the Company at a point thereon ninety yards or thereabouts south-east of the mila post an the said Railway near Ivor Junction denoting eighteen and a quarter miles, and termi- nating by a junction with the Railway from Brecon to Merthyr of the Brecon and Merthyr Tydtil Junction Railway Company at a point thereon one hundred and seven yards or there- abouts south-east of the mile post thereon denoting nineteen miles; Railway No. 2, to be wholly situate in the said pariah of Merthyr Tydfil, commencing by a junc- tion with the said Dowlais Extension Railway at a point thereon one hundred and twenty-three yards or thereabouts north-east of the weighing machine office on the said Railway near Ivor Junc- tion, and terminating by a junction with Railway No. 1 at or near the new public road leading from Dowlais to Pantyscallog, at a point eighty yards or thereabouts south-east of the east corner of the Pant Hospital; Railway No. 3, commencing in the said parish of I Merthyr Tydfil, by a junction with Railway No. 1, at a point two hundred and fifty yards or there- abouts south-east of the mile post on the Railway from Brecon to Merthyr of the Brecon and Merthyr Tydfil Junction Railway Company denoting nine- teen milee and terminating in the said parish of Merthyr Tydfil by a junction with the Vale of Neath Railway of the Great Western Railway Company, at a point thereon seventy-two yards or thereabouts south of the junction of the Brecon and Merthyr Tydfil Junction Railway with the said Vale of Neath Railway; which intended Railway will be wholly situate in the said parish of Merthyr Tydfil and the parish of Faenor, in the county of Brecon Railway No. 4, to be wholly situate in the said parish of Merthyr Tydfil, commencing by a junction with Railway No. 3 at a point one hundred and twenty- seven yards or thereabouts north-west of the Llwyncelyn Signal Box on the Brecon and Merthyr Tydtil Junction Railway, and termi- nating by a junction with the Mineral Railway called the Gethin Railway, at a point thereon twenty-five yards or thereabouts south-east of the said Llwyncelyn Signal Box; With power to the Company to stop up and discontinue as a publij highway so much of the old public road leading from Dowlais to Pantyscallog as lies between the point where such road is crossed on the level by the Brecon and Merthyr Tydfil Junction Railway and the point where such road is proposed to be crossed by Railway No. 1; and with respect to the station and terminal accommodation and other facilities and services to be afforded and rendered by each of the two Companies to the other of them and with respect to the division and apportionment of the receipts arising from traffic and other- wise in relation thereto and to confirm any agreement entered into between the two Companies in relation to any of the matters aforesaid: To empower the Company to increase their capital, and to raise a further sum of money for all or any of the pur- poses cf the intended Act by the creation and issue of new shares with or without a guaranteed or preference dividend or other rights or privileges attached thereto, or by the creation and issue of debenture stock, or by borrowing on mortgage or bond, or by any of such means; (incorporation of Company Reclamation of Land; Arrangements with Cambrian Railways Company Purchase of Land by Compulsion and Agreement Contributions for maintenance of Embankments.) NOTICE IS HEREBY GIVEN, that application -131 is intended to be made to Parliament, in the ensuing Session, f oi leave to bring in a Biii to elfect all or some of the objects following viz. 1. To incorporate a Company for the purposes of the said Bill, and to confer upon such Company (hereinafter called the Company ") all necessary or desirable powers for the reclamation of land in and adjoining the estuary of the River Dovey in the counties of Cardigan and Merioneth, or oue of them, and especially the powers following (that is to say) :— 2. To construct an Embankment for the purposes of such reclamation, Vith all proper sluices, openings, bridges, dams, gates, and other works and conveniences connected therewith, which embankment is intended to commence at or near a point on the deposited plans of the Aberystwith and Welsh Coast Railway referred to in the Aberystwith and Welsh Coast Railway Act 1861, where the centre line of the Railway, called in that Act Railway No. 2, crosses the embankment, numbered on the same deposited plans 40, in the parish of Llancynfelyn, in the said county of Cardigan, and after passing in a westerly direction, and then in a northerly direction, and then up tha estuary of the river Dovey is intended to terminate in the parish of Llanfihangel-Geneur-Glyn in the said county of Cardigan by a junction with the line of the Cambrian Railways at or near the point marked on the centre line of the deposited plans of railway No. 5 mentioned in the said Act as denoting the distance of 4 miles and 2 furlongs from the commencement of such railway No. 5 which said em- bankment and works will be made in or pass from, through, or into the several parishes, townships, and extra parochial and other places following, or some of them (that is to fjay) :-Liancynfelyn inthe said county of Cardigan, Towyn in the said county of Merioneth, and Llantihangel-Creneur- Glyn, in the said county of Cardigan. 3. To alter or narrow the channel of the said estuary or river so far as such alteration or narrowing may result from or be incidental to the construction of the proposed em- bankment and other works. 4. To purchase and acquire lands and hereditaments by compulsion and agreement for the purposes of the Bill, and to sell or lease any lands which the Company may from time to time, or at any time, acquire under or by virtue of the provisions of the Bill and to authorize the Company to hold and retain the reclaimed land for any period, or to let sell or dispose.of the same and to require the owners and occupiers of the reclaimed lands and lands adjacent thereto to contribute and pay rates to and for the maintenance of the embankment and works and to appoint Commissioners for the purpose. 5. To raise capital by the issue of shares and by bor- rowing. And by the said Bill, provision will be made for effecting the purposes following, or some of them (that is to say):— 6. To vest in the Company, subject to the provisions of the Bill, the lands and heriditaments, to be reclaimed by means of the embankment and works of the Company, and to vary or extinguish all rights or claims whatsover in or affecting lands to be acquired by or vested in the Company under the provisions of the Bill and to determine of what Counties and Parishes the reclaimed lands shall form part. 7. To confer upon the Company and upon the Cambrian Railways Company powers of entering into and carrying into effect contracts and arrangements for or with reference to the maintenance of so much of the line of Railway ef the said Railway Company .as lies at near or between the points of commencement and termination of the proposed embankment or on or near the banks or shore of the said river or estuary or of the proposed embankment or works of the Campany or with reference to the acquisition of iinrimsea ofnj-ooni^ or with reference to anv contribution to be made byeiCher Oouip^j or the payments or allowances to be made by either Com- pany to the other in respect to the benefits to arise to the undertaking of either Company by the construction of the works or any part of the works of the other of them and to confer upon such or either Company power of contribut- ing funds and of applying their funds aud revenues for the purposes of and of holding shares in the undertaking of the other of them and of raising further capital by shares and by borrowing for the purposes aforesaid. 8. To amend or repeal the Dovey Reclamation Act 1862 the Aberystwyth and Welsh Coast Railway Act 1861 the Cambrian and Coast Railways Act 1865 and the Cambrian Railways Act 1868 and all or any other Acts affecting the Cambrian Railways Company. 9. To confer upon all persons and Corporations (including the Crown) having limited powers or who but for the pro- visions of the Bill would be incapacitated to convey lands to the Company the fullest powers of conveying any lands or hereditaments for the purposes of the Company or any interests therein and of entering into and carrying into effect contracts or agreements with the Company with re- ference thereto. 10. Duplicate plans and sections of the intended embank- ment and works shewing the situation and levels thereof with a book of reference to such plans and plans of the lands, and hereditaments intended to be taken compulsorily or vested in the Company under the provisions of the Bill with a Book of Reference to such plans and a copy of this Notice as published in the London Gazette will before the 30th day of November instant be deposited for public in- spection at the Office of the Clerk of the Peace for the County of Cardigan at Aberystwyth in that County and at the Office of the Clerk of the Peace for the County of Merioneth at Dolgelly in that County: and on or before that day a copy of so much of the said plans sections and books of reference as relates to each of the parishes and extra-parochial places from in through or into which the said intended works will be made or pass and a copy of this Notice as published in the London Gazette will be deposited for public inspection in the case of each such parish with the Parish Clerk thereof at his residence and in the case of each such extra-parochial place with the Parish Clerk of some parish immediately adjoining thereto at his residence. To levy tolls rates and duties for the use of the same in- tended Railway or tramway and works to alter tolls rates or duties and to confer vary or extinguish exemptions from tolls rates or duties. To alter amend and enlarge some of the powers and pro- visions of the said Bala and Dolgelly Railway Act, 1862, and the Bala and Dolgelly Railway Act, 1863. The Bill will vary and extinguish all existing rights and wivileges which would interfere with its objects and it will incorporate the necessary provisions of The Lands Clauses Act, 1845," "The Lands Clauses Acts, 1860 and 1869," The Companies Clauses Acts, 1845, 1863, and 1869," The Railways Clauses Acts, 1845 and 1863," or some part or parts of such Acts respectively. NOTICE IS HEREBY GIVEN that application is intended to be made to Parliament in the next Session for an Act for all or some of the following (among other) purposes, that is to say,— 1. To transfer to and vest in, or to authorize and provide for, the transfer to and vesting in the Mayor and Burgesses of the Town, Borough, and Liberty of Aberystwyth (here- inafter called the Corporation "), on such terms and con- ditions as have been or may be agreed upon, or as may be fixed by or under the provisions of the Bill, the Harbour of Aberystwyth and the whole Undertaking, Piers, Jetties, Breakwaters, Docks, Quays, Wharves, Landing-places, Shipping-places, accesses, passages, ways, roads, tramways, railways, works, lands, storehouses, offices, buildings, land- marks, plant, Quarries, property, appurtenances, matters, and things connected with the Harbour of Aberystwyth, or now belonging to or held, used, and enjoyed by the Trustees constituted and appointed by or acting under the Local Acts relating to the Harbour of Aberystwyth, 20 George III., cap. 26, and the 6th William IV., cap. 41, or either of them (hereinafter called "the Harbour Trus- tees"), and all rights, privileges, powers and juris- diction granted or conferred by the said Acts, or either of them, upon the Harbour Trustees, and the tolls, rates, duties, and charges leviable or receivable by the Harbour Trustees under the said Acts, or either of them All which Undertaking, Piers, Jetties, Breakwaters, Docks' Quays, Wharves, Landing-Places, Shipping-places, accesses', passages, ways, roads, tramways, railways, works, lands, storehouses, offices, buildings, landmarks, plant, Quarries, property, and effects real and personal, appurtenances, matters and things, rights, privileges, powers, authorities, jurisdic- tion, tolls, rates, duties and charges (except where other- wise expressed, or where there be something in the context repugnant thereto), are hereinafter called and included in the term The Harbour Undertaking." 2. To authorize the Corporation to work, regulate, manage, improve, repair, and maintain the Harbour Undertaking, or sch parts thereof as may be needful or expedient, to provide, hire, and use Vessels, Boats, and all necessary engines, plant, matters, and things, to appropriate or to sell, demise, let, and dispose of any part of the Harbour undertaking, works, lands and property vested, or to be vested, in them, as they may from time to time consider necessary or expedient, to make Bye-laws, rules, and regu- lations with respect to the working and management of the Harbour and other matters and things relating thereto, and to use and exercise all the powers, rights, privileges, authorities, and jurisdiction conferred by the said Acts, or either of them, on the Harbour Trustees, and all other powers, rights, and privileges to be conferred by the said Bill which may be necessary or expedient for the working, regulation, management, improvement, disposal, and main- tenance of the Harbour undertaking, works, lands, and pro- perty connected therewith, or the objects of the Bill, or any of them. 4. To enable the Corporation to enter into and carry into effect agreements or arrangements with the holders of, and otherwise to provide for ascertaining and determining the amount and value of the Mortgages, Bonds, and other debts and securities incurred or issued by the Harbour 1 rustees, and to cancel and extinguish either in whole or in Trustees, and to cancel and extinguish either in whole or in part the principal and interest moneys, or either of them due in respect thereof, to reduce the amount or rate of interest to be payable in respect thereof, and to extin- miish defer or suspend the accrual and payment of such intere'st for'such period or periods as may be agreed on, or as may be fixed by the Bill, to authorise and provide for the Corporation paying or guaranteeing the payment of the amount or value of the said principal moneys and interest, as ascertained and determined, or as may be provided by the Bill, by and out of the funds, rates, duties and revenues belonging to, or levied, or received by them under the authority of the Acts relating to the Harbour Undertaking, or of the Bill, or out of the rents and profits of the Corporation lands, hereditaments and tenements, or some part thereof, or other revenue belonging to them, or from and out of any moneys to be borrowed under the authority of the said Acts, or either of them, or of the Bill to authorise the Corporation to cancel and annul any Mortgages, bonds, obligations, or other securities issued by the Harbour Trustees, and to issue Mortgages, bonds, ob- ligations, and other securities in lieu thereof, to alter, vary, suspend, repeal, or extinguish all or any existing rights and privileges of Mortgagees, bond-holders, tally-holders, and other creditors, as may be provided in the Bill, and particularly to alter amend or repeal the 14 Sec. of the said Ant of the 6 William IV., Cap. 41, providing for the application of the moneys to be received by the Harbour Trustees under the said Acts relating to the Harbour Undertaking, or either of them, and to make other pro- visions for that purpose affecting the rights of Mortgagees, bond-holders, tally-holders and creditors in lieu thereof, and to make such moneys to be received by the Corpora- tion from the Harbour Undertaking applicable in the first instance to the working, maintenance, and repair of the Harbour Undertaking or otherwise, as the Bill may pro- vide. To enable and require trustees, executors, guardians, and persons having only limited interests, or being under any disability, and entitled to or interested in any mort- gage, bond, or other security issued or made by the Har- bour Trustees to consent to and concur in any arrangements which may be made under the powers of the Bill for the settlement of any debts or claims or to forego any part thereof and to accept other security or securities in Jieu of that or those now held by such person for the whole or part only of such debt or claim. c J_I_ 5 To authorize the Corporation to borrow money for the purposes of the Harbour Undertaking and of the Bill on the security of the Harbour Undertaking and of the tolls rates duties and charges which they may be authorized to levy under, the authority of the said Acts relating to the Harbour or of the Bill or upon security of the Corporation property or any part thereof and to apply the funds rates duties and re- venues belonging to or levied or received by them under c the authority of the acts relating to the Harbour or of the Bill or otherwise or so much thereof as may be required for the purposes of the Bill. 6. To authorize or confirm the construction and mainten- ance of a Branch Railway Tramway or Siding already con- structed with all needful works approaches and conven- iences situate in the parishes of Llanfihangel Lledrod otherwise Lledrod and Ystrad-Meirig otherwise Yspytty Ystrad-Meirig or one of them in the county of Cardigan commencing by a Junction with the Manchester and Mil- ford Railway at a point measured in a north-westerly direc- tion along the last mentioned Railway 132 yards or there- abouts from the post marked and denoting 28.1 miles from Pencader and terminating in or near to a Quarry abutting on the public road leading from Aberystwyth to Ystrad- Meirig and belonging or reputed to belong to William Evans and in the occupation of the Harbour Trustees. 7. To cross divert alter or stop up or otherwise interfere with either temporarily or permanently roads railways drains streams and watercourses so far as may be necessary in constructing maintaining or using the said Branch Railway tramway or siding and works. 8. To enable the Corporation to purchase compulsorily and by agreement lands houses or other property for the purposes of the said Branch Railway tramway or siding and works or for the Harbour undertaking and also a cer- tain stone quarry and Lands adjoining thereto situate in the Parish of Ystrad-Meirig, otherwise Yspytty Ystrad- Meirig aforesaid and belonging or reputed to belong to William Evans and to vary and extinguish all rights and privileges connected with such lands and property which, would interfere with or prevent the carrying into execution of any of the objects of the Bill. 9. To enable the Harbour Trustees to transfer aui 1 assign to and the Corporation to accept transfers or assign- j ments of all contracts agreements leases or agreements for I leases of lands held by them and also an agreement or ] contract between the Harbonr Trustees and Henry Enfield Taylor having reference to the making maintenance and user of a Branch Railway or tramway from the Manchester and Milford Railway to the Harbour of Aberystwyth aud to confirm any agreements relating thereto already made and to empower the Corporation to enter into further agreements with reference to any of the purposes aforesaid. 10. To terminate wind up or dissolve the Trust reUtiug to the Harbour undertaking created by the said Acts or either of them. 11. To continue or to alter and vary the existing tolls rates and duties or any of them leviable under the autho- rity of the said Acts relating to the Harbour undertaking or to repeal the said tolls rates and duties or any of them in whole or in part and to levy new or increased tolls rates and duties in respect of the Harbour undertaking and to confer vary or extinguish exemptions from payment of the several existing or new tolls rates and duties or any of them. 12. To authorize the Corporation to demise and lease for 75 years or such other term as may be prescribed by the Bill renewable in perpetuity or otherwise and upon build- ing leases or otherwise any of the lands houses buildings and tenements belonging to or vested in the Corporation upon payment of an annual reserved rent and with or with- out a fine or premium or subject to such other rent or money payment as may be prescribed by the Bill and upon and subject to such terms and conditions as the Corpora- tion may deem expedient or as may be agreed upon between the Corporation and such Lessee or intended Lessee or as may be prescribed by the Bill. 13. To enable trustees executors guardians and persons having a limited interest in or being under any disability holding or being interested in any lands houses buildings and tenements the property of and held under leases granted by the Corporation whether under any disability or not to surrender and determine such Leases and to accept new leases in lieu thereof for 75 years or such other term as may be prescribed by the Bill renewable in perpetuity or otherwise and upon payment of such annual or other reserved rents and of such fines or premiums or other money payment as may be pre- scribed by the Bill and upon such terms and conditions as the Corporation may deem expedient or as may be agreed upon between the Corporation and such Lessees or in- tended Lessees or as may be prescribed by the Bill and to enable the Corporation to accept such surrenders and to grant such new Leases. 14. To define and fix a scale of annual or other rents fines premiums or other payments to be made to and taken by the Corporation on the granting of leases of the Corpor- ation lands houses buildings and tenements whether such leases be granted in connection with the surrender of an existing Lease or Leases or not and the Bill will provide for the appropriation of the moneys to be received by the Corporation in respect of such fines annual rents and other payments to the Harbour undertaking in the reduction of the Borough rates or in carrying into effect works of public utility and Improvements within the said Borough or otherwise in the manner and to the purposes to be specified in the Bill. 15. To vary or extinguish all existing rights and privi- leges in or connected with the Harbour Undertaking and all other rights and privileges which might in any manner interfere with or prevent the execution or attainment of the objects of the said Acts and the Bill and to confer all powers rights and privileges necessary or expedient for effecting those objects or in relation thereto. 16. To alter or amend the said Acts 20 Geo. III. Cap. 26 and 6 William IV.,Cap.41 relating to the Harbour undertaking or to repeal the said Acts in whole or in part and to consolidate and re-enact the powers and provisions thereof or some of them with such new or additional powers and provisions as may be necessary or expedient for carrying into effect the objects of the said Acts and of the Bill and to alter amend enlarge or repeal so far as may be necessary for the objects of the Bill the following Acts local and personal (that Is to say) The 16 and 17 Vic Cap 143 and all other Acts relating to the Cambrian Railway Company the Manchester and Milford Railway Act 1860 and all other Acts relating to The Manchester and Milford Railway Company the Municipal Corpora- tion Act 5 and 6 William IV.
