GUN FATALITY NEAR NEATH MAN ACCIDENTALLY SHOT IN A SIGNAL-BOX. A sad accident occurred at the Cefn Mawr Signal-box on the Great Western Railway at Clyne, nt-ar Resolven, on Saturday afternoon re.,ultin in the instantaneous death ot a tin- nmtpr Iiumeil "hilip MaddockB. aged eighteen ™° re-.umi with h., parents at 5eig,Y. v-ottatses. l'he circumstances connected with the Htality are as follows:-Early last week Hid brokers, named Dauiel and Wm. Davies, of Nv. 6. c Cyd-terraee, Clyne. purchased at Neath a cheap double-barrelled breechloader sporluis gnu. On Satnrdar afternoon they df'<?cd to go oat. w?h the view of getting a shot at stray pigeons, if the opportunity occurred. Daniel Davies loaded the gaD. and PUta-ia the house SMve it to his brother Willi4m to carry. When near the signal-box they met Madd0c1;s. who went with them a< far as the signal-box for the purpose of getting a few matches. They were supplied with a light by William Andrews, the signal man, and when about to leave the box the left barrel Of the sun discharged, the shots penetrating Maddocks s left side under the heart. A por- tion of the charge must have entered the heart for Maddocks simply uttered the words. "I am dyiug." and fell dead at the feet of his com- panions. Dr. Pritehard. of Resolven, was sent for, and information given to Police-sergeant Martin, who took William Davies to the county polioe-station at Neath. Davies was subse* qnently let out, on bail on his own recogni- sances. The inquest will be held by the County oeroner (Mr. Cuthbertson) to-morrow (Tuesday). How the sun went off is not exactly known. William Davies says be did not know that the gon was loaded. Davies is a single man, living at home with his parents. Deceased was very popular in the locality, and the sad catastrophe has spread quite a gloom over the jjictureaque village of Clyne.

EXTRAORDINARY REQUEST TO THE LOCAL GOV-ERN-ATENT BOARD, At a meeting of the Bridgend and Clowl)rid$L,(, Board of Guardians on Ratur- day the toftagp homes committee recom- mended that on account of the eood work done at the homes during the last twenty years, the board memorialise the Local Government Board to sanction the exit- i ng system of educational and industrial training.T.; Chairman, in reply to a vneuibe-r, si i (I the Local Government Hoard had laid down a law that poor-law children were not to be employed as half- timers. So far the guardians had been able to evade the adoption of that Act and with the knowledge that they were continually transfrressing the law they now wished to have the matter settled definitely. Mr. T. L. Roberts opposed the recommendation on the grounds that all children should have a complete and unin- terrupted scholastic training up to that sige wh?n they would leave school entirely -OiL being put, the recommendation was adopted whereupon the Chairman remarked You need not trouble It is extremely unlikely that the recommenda- tion will be approved of by the Local Government Board. ——

I This was a case in which Evan Jones sought to secure the cjectment of Mr. E. J. Edmunds as tenant of the Victoria Inn, Quakers' Yard. Mr. H. FrancJs-WilliamB and Mr. Trevor Lewis (instructed by Messrs. Lewis and Jones) ap- peared for plaintiff, while Mr. John Sankey (in- structed by Mr. J. W. Lewis) was counselJor the defence.—Plaintiff's contention was tiiat defendant had violated the covenant8 of his lease, and for that reason he asked the court to terminate the lease.—In the end a suggestion made by his lordship was accepted by both Parties. This was to the effcct that defendant should have relief on the terms that he found a fit and proper person to purchase his lease and transferred the licence to that parson within two months. VacheU and Co.) d.f..dd.-It appeared that on July o a contract was entered into between the parties for the delivery of 3.600 tons of coal at Liverpool, delivery to be made and taken in about equal fortnightly quantities of 350 torts up to the end of the year. The contract price was 9s. 9d. per ton. The action hinged upon the interpretation of the clause as to delivery.-His Lordship decided in favour of plaintiffs on the clause and gave judgment for C92 damages. The case turned upon the construction of a dfted of separation signed by the parties In June. 1897. Under that deed Mrs. Jones was to reoeive £2 a week for her maintenance. and it was urged on her behalf that that sum was not meant nor intended to cover the cmt of maintaining the children. The defence wA, that the £ 2 covered everything. Mr. S. T. Evans, M. P appeared for plaintiff, and Mr. B. Francis-Williams, Q.C., for the defendant.-T'?,? case was partly heard on Friday, and when the court adjourned the judge strongly urged the parties to come to an amicable settlement. When the case was called on Saturday morn. ing Mr. B. Francis-Williams announced that counsel and clients had been in consultation, but could not come to terms; therefore, the case would go oIL-No further evidenoe was called, and Mr. Francis-Williams argued that plaintiff, according to the deed, undertook liability for the children. The deed Eet forth that the £2 was to be for her sole and eeparate use until their marriage might be diszolved, and he contended that the part which stated that during their separation the wife should indemnify her husband from all debts, ex- penses for wearing apparel. and board or other- wise, included the maintenance of the children. The wife was to have the custody of the chil- dren, and what could" otherwise" mean but the children?—The Judge pointed out that the word "her" was the governing word there. Everything related to her." He also pointed out that there was a provision that the children lr:dh go hack to their rather.-Mr. Francis- Williams replied that that was oua of the circumstances which went to prove defendant's intention that the £2 should include everything. It was to liim inconceiv- able that the wife when bargaining for sepa- ration and the custody of the children should not have counted the cost of their mainte- nance, and she agreed to £2 a week. He would say that the person who took the children oontracted to pay for them.-The Judge said he thought plaintiff was entitled to recover, not the sum claimed. but 80 Bum he should pro- nounce for. The important covenant in the deed was that during the continuance of the separation the plaintiff would keep the cWl- dren and indemnify her husband, the defen- dant, against all debts oontracted for her, whether for wearing apparel, maintenance, or otherwise. His Lordship held that that did not throw upon her a contractual liability to main- tain the children. Therefore, the husband still remained liable to maintain the two chil- dren, at the present time, at all events. As to whether the wife could sue the husband for money expended by her for maintaining the children—Arst of all, it was B:iid she could by implied contract, as ho had allowed her to spend her separate estate upon the children. HIe thought she could recover a reasonable sum under that implied contract. He would. therefore, hold that defendaut was reeponsible as the father, thai the deed of separation did not take the responsibility away from him. and that the plaintiff had a right to sue him in respect of the moneys pairl by her for the children. As to the amoemt. taking into con- sideration the position of the parties, he should say 7s. 6d. a week for 104 weeks for each child for maintenance generally was sufficient, and that c2D would be sufficient for clothing. He, therefore, gan judgment for X94 10.. for ,fn: tenance and £20 for clothing-total R114 10s.- and costs.—Mr. Francis-Williams asked for a stay of execution.—His Lordship granted the request, but expressed the hope that the parties would he able to settle the matter soon and stop the regrettable waste of money that was going on in litigation. ACCOUNTANT S ACTION. Jonefl v. Morris and others.—In this case Mr. John Griffiths Jones, chartered accountant, of Cardiff and Pontypridd, sued Mr. Thomas Morris and others, of Pentre, for L121 159, 4d., being emuneration for work done in connec* tion with the affairs of the Ynysywen Building Club. Mr. B. Francis-Williams, Q.C., and Mr. Ivor Bowen (instructed by Messrs. Meyrick and Davie# Cardiff) were for the plaintiff, and Mr. S. T. Evans, M.P., and Mr. Anton Bertram (instructed by Mr. Howell, Llanelly) for the dcfendanUi-In opening the case Mr. Francis- Williams said the defendants were members of the building club mentioned, which origi- nally consisted of seventeen members. Eight members, he though;, had been settled with. and there were nine now. defendants in this action. Disputes arose, and the dub got into a sort of difficulty, and the present defendants brought an action in the Challcery Division in June, 1895. against three of the other memo bers, two being the trustees and one the were- tary. It should be borne in mind that the defendants in the present case were plaintiffs in the Chancery action. They were not satis- fled with the accounts prepared by a Mr. Richards, who was not a chartered accountant, and the plaintiff in the present action was instructed to go into the accounts and pre- pare a statement on behalf of the nine present defendants. In consequence of what had hap- pened he received instructions from Mr. G. Bruce (of Messrs. Morgan, Bruce, and Co., soli- citors, Pontypridd) acting for the then plain. tiffs (the present defendants) to do the work. There were a good many interviews and many accounts to go through. and altogether there was a lot of work done.—Plaintiff was called, and said he had done the work charged for by him, .d while he ?- giving his evidence the tto :r: to whether he 9hon]d h?vR sued the whole club or only the present defen- dants, the Judge remarking that, no doubt, somebody should pay, but who? It appeared to him that, looking at the documents and the evidence it was understood and agreed that plaintiff should act for the club. Plaintiff said that before the action was brought he offered to settle for £100.- Cross-examined, he &a<id he had not many nor large booin to go through, but he had to gr, through these and tho accounts from 1890 ti 1895, and make them up.—Mr. Gerald Brn, also gave evidenoe in support of ptaint C" claim. He Faid he acted for the present defen- dants in the Chancery action, and asked th present plaintiff to send in his account in con- nection with the building duh. He protested that the defence was not an honest one.—After some further argument as to costs, a limit. "f £ 25 being mentioned, judgment was entered for defendants, with costs. a stav of execution was granted on the applkation of plaintiff's counsel, and. if there be an appeal and the appeal dismissed, the judgment wonld I he for defendants, with taxed costs, This concluded the business of the assize before his lordship.

Annie Baker was charged on a warrant with assisting in the management of a disorderly house at 36, Millicent-atreet, on March 3O.-Police-constable Wootton (37 A) detailed how he had watched the house for about a fort- night, and gave an account of his inspection of the house at midnight on Friday.—Inspector I Durston proved a long list of previous con-1 Tictions against Baker, and stated that, although defendant had only been in that house for about three weeks, there had been no less than six robberies reported to the police j which were stated to have taken place there. He would say it was the worst house of its kind in Cardiff.-Tlie Bench sentenced Baker to four months' imprisonment. MTHER AND DAUGHTER. narnet rauny uaggs Bosmer, aged eleven, of 29, Upper Kingcraig-street, Cardiff, was charged with obtaining a large quantity of clothing and similar articles on false pretences, the property of a Mr. Ll. Brookes, and her mother, Fanny Boshier, was charged with receiving them. Without any evidence being given, the child was remanded till to-morrow (Tuesday). Her mother, when charged at the police-station, replied, "I did not know they were got by false pretences." A similar course was taken with her, and bcth cases will be dealt with by the bench to-morrow (Tuesday) morn- ing.

'Change was fairly well attended to-day, but, as is usually the case on the last day of the week, very little animation was noticeable in any department. Steam coal prices, however, were firmly upheld, and an advance appears to be impending, as the commodity is very scarce for early shipment, and, in view of the abnormal advance in the miners' WB. a steady curtailment of the output from now on to the holiday may be anticipated with some degree of certainty. House coal and patent foel quotation- were unchanged, but coke values had again an upward tendency. Closing prices:—Best steam coal 218 to 22s 6d, seconds 198 to 19. 6d, and drys 17. 9d to 18s; best steam smalls 138 9d to 14s, seconds 13s 3d to 1311 6d, inferior, including drys. 128 6d to 12s 9d; best Monmouthshire semi-bituminous large 183 to 18s 3d, seconds 16s 6d to 178 3d; best households 21s to 23s, seconds 186 to 19s; No. 3 Rhondda large 20s to 22s, brush 19s, and small 17.; No. 2 Rhondda large 15s 6d to 16s, through and through 14s to 14s 6d, and small 13s to 13s 6d; patent fuel 19s to 21s; special foundry coke 36s to 36s 6d. foundry 33s to 33s 6d, and furnace 30s to 32s per ton-above quotations are all f.o.b.. cash in 30 days, less 2 per cent. Rates for Italy and the higher Mediterranean ports had a light downward tendency. For the Plate and South American ports eenera'ly there was a steady demand, with a firm market.
