WHITBY SHIPPING CASE. THE JUDGMENT. Mr. Justice Bruce gave judgment on Jt jday in the Commercial Court of the Queen's Tleach Division of the High Court in the case of Rowland and Ma-wooXd Steamship Company (Limited), of Whitby, T. Nilson, Sons, and Co. (Liinited).-His Lordship, m giving judgment, said there was a provision in the charter-party that the defendants should be allowed despatch-money for the timfe saved in discharging, and some time was, in fact, saved in discharging, for which the plaintiffs had made due allowance. The clvarter-party did not contain in terms any similar provision in respfect to the time saved in loading, but defendants, m the absence of any express provision in mpeot of time saved in loading, relied upon the fifth clause, which said that any hours savfed in loading were to be added to the hours saved in discharging. He ooold not accept that contention, because he thought that olause only applied to demurrage, and that the hours saved in load- ing wwo only to be added to the time saved in discharging for the purpose of calculating demurrage. He thought the general r tenour of the dharter-party confirmed that view, M there wart distonct provisions in it with respect to the time allowed foT loading aod discharging. He must, therefore, give judg- ment for the plaintiffs for the amount claimed with costs on the higher scale.
