THN LAST HOURS OF THE MODOC…
THN LAST HOURS OF THE MODOC CONVICTS. The Herald of the 4 h contains a long account of the last hours of the Modoc convicts, who wen •touted that morning for the murder of Genera Cuiby and the peace commissioners. On the even- ing of the 3d General Wheaton, accompanied bj the post chaplain and the Herald's correspondent, proceeded to the guard house where the convicts wen Confined, to apprise them to their fate. Tbe com- tanuioation was made by the chaplain, through ar Interpreter. The captives evinced considerabh interest, and they were evidently striving hard to Maintain composure. Tb^y had a very stolid ap- pearance, but the nervous twitching of the handt -nd the restless wandering of the eyes showed thai the blow struck hard. Boston Charloy kept steadily "hewing tobacco while the sentence was beiup øpoken, and squirted the juice about the floor in t nonchalant style, as if nothing of any importance wae taking place. Sconcbin expressed his contemp* for tbe whole matter, lying back on the bunk, and ÏJ. the most expressive manner, as if the entire pro Qeedings were rather a bore. Jack appeared to taht the.Bewa very coolly, but bis bright and sparkling eyes appeared unusually brilliant, and gazed around the circle in a quick and restles* manner. Tbe in terpTeter then informed them, by order of the pre- •ident, that their wives and families would be taken good care of, also that General Wheaton was now Prepared to hear any remarks they had to make. Captain Jack delivered a lung harangue, the otjee. of which was to "how that he was not responsible fOl the massacre. He said, I have beard the sentenc. Ind know what it is but I feel tbat I am more iD- nocent than B«.»gus Charley, Hooker Jim, Steamboat *Vank, and Shack 'Nasty Jim; that these met Planned and instigated the crime of which I am Leased. When I look at my heart I see no crimt there. Young men started these murders. ItV hard to rid them of their savage habits. I was always in favour of peace, and Bogus Charley was the first to propose the murder of General Ctinhyand the peaoe commissioners. These young men wert "hh him. I said no; but they had the power and Carried me with them. We came near a personal difficulty.' He accused Bogus Charley, one of thf Spited convicts, of having been the instigator of the "rime, and made several appeals to General "Wheaton that his life should be spared, all-endinp with a proposal that his relative, Soar-faced Charley, 8bonld be executed in his stead, so that he might live to take care of his family. Finding all hit- appèalø vain, he became resigned, and said, 'I am **ady to go and see my Great Father above.' The two Combatesdre also displayed great fear of death, and prayed that their lives might be spared, but Boston Charley, the youngest of the convicts, received the intelligence of hia fate with unbroken oomposure. I' I am a boy,' be said, • but I feel like a man. When 11 look on each side of me I think of those other men as women. I am wholly man, not half woman. I killed General Canby, assisted by Steamboat Frank, and Bogus said,• Do you believe these commissioners ttiean to try to make peace with us?' I said, '1 believe so! He said,' I don't believe BO they want to lead us into some trap.' I said, All right, I go with you.' Captain Anderson remembers when tlogos came in camp in the evening and when I camt in the morning. I would like to call my people and bid them good bye to day. I would like to go to tbe Blockade. I am young I know but little. When 1 lIee anything with mine eyes I know it.' B-. ston was then asked why they killed Canby and the commis- sioners. He said that all tbe presents they received had no influence on them, and they suspected Canbj and the commissioners of treachery. Boston theD blade a long harangue, in whioh he tried to show that Jbck had no share in the massacre, and that be had worked very hard in keeping the young men quiet. He appeared to lay all the blame ou The correspondent of the Herald thus writes :— The prisoners were shortly afterwards returned their cells, and at five p.m. were visited by their families. This was the first meeting sinoethe death Warrant bad been public, and it was to be the last before death separated them for ever on this earth, it would naturally have been affecting but I was Perfectly unprepared for the frantic state of grief into "hioh the women worked themselves. They howled their weird death song, and threw themselves od ♦heir doomed friends, fawning upon them all over. tven the little children seemed to catch the affection *od they cxied and wept in the most finished style, ^ack appeared very much affected at meeting his fevonrite squaw Lizzie and the little papoose. Hta lister Mary was even more affected, and worked her- "elf into a perfect paroxysm of grief. The little &rl appeared to comprehend the situation and Sobbed bitterly. As Jack gave her one last fond brace the squaws returned to the stockade, and the murderers were left in their oells with no other Companion than the gloomy foreboding and anticipa- tion of the morrow. Old Sconcbin met his family Without rnuoh viable emotion but bis children Cltied bitterly and the squaws jelled as if the world ^*8 coming to an end. The chief did not betray ^Dy outward signs of agita'ion. He kissed Lia little repeatedly, and when bis family were taken away ho Jay down in bis cell and rolled himself like a ball hi hia blanket^

The accuseddid not claim them, but his having fallen at that spot to say the least was very remarkable, particularly when coupled with a letter found in his box, the contents, of which was not made public, but supposed to have come from an accomplice. Tho case was adjourni d for a week to enable the Chief Constable to com- municate with the officers of the Mint respecting the prosecution. KEEPING A DOG WITHOUT A LICENCE. The Board of Inland Revenue by the acting supervisor, charged George Thomas, a Railway Watchman at Newton Noyes Pier with keeping a dog without a licence. Defendant said the dog was not his. James McLaren charged Peter James with calling him a d--d swindler and rogue, and threatening to stab him with the Evil he had in his hand, and witness declared he was afraid of him. The evidence shewed that defendant was in the employ of complainant until the 10th inst., that on the Saturday previous the men and boys were digging potatoes in a field, when a misunderstand- ing arose respecting some potatoes, defendant ask- ing his master for two drills, and on his being told that he was only entitled to one drill, he got into a t.owering rage, and used the language and threat complained of.
