NOTICE IS HEREBY GIVEN that appHca- .1 tion is intended to be made to Parlia- ment in the ensuing Session by the Great Western Railway Company (hereinafter called "the Com- pany "), for an Act under the above name or short title for all or some of the following pur- poses, that is to say:- To enable the Company to make and maintain the Railways and works hereinafter mentioned, or some of them, or some part or parts thereof together with all necessary stations, sidings, approaches, roads, works, and conveniences con- nected therewith, to be wholly situate in the County of Denbigh, viz:— 1.—A Railway (No. 1) commencing by a junc- tion with the Shrewsbury and Chester Railway of the Company, at or near the bridge carrying the public road leading from Pentre Christionydd to Ruabon., over that Railway about 5 chains north-eastward of the north-eastern end of the station buildings at the Ruabon Station, and terminating by a junction with the Pontycysyllte Branch of the Shropshire Union Railways and Canal Company (hereinafter called the Shrop- shire Union Company") at a point thereon about 15 chains south-eastward of the bridge carrying that Railway over the road leading from Stryt-isaf to Pant. 2.—A Railway (No. 2.) commencing by a junction with the said Pontycysyllte Branch, at or near a point thereon about six chains from the termination of the said Branch, and terminating by a junction with the Legacy Colliery Branch Railway of the Company, at or near a point there- on about three chains south-westward of the crossing of that Branch by the road leading fro/n Bryn-gryffydd to Rhostyllen. 3.-A Railway (No. 3) commencing by a junction with the said Legacy Colliery Branch at or near the termination of that Branch, and ter- minating by a junction with the said Shrewsbury and Chester Railway, at a point thereon about nineteen chains north-eastward of the crossing of that Railway by the main road leading from Ruabon to Wrexham. a. All which intended Railways will pass from, in, through, or into the several parishes, township?. extra-parochial, and other places following, or some of them, that is to say :-Ruabon, Wrex- ham, Rhosllanerchrugog, Moreton Above, Moreton Below. Penycae, Cefn. Esclusham Above, Esclu- sham Below, Johnstown, Ponkey, DinhunlleUclia, and Erthig. To enable the Company to purchase by agree- ment or compulsion, and to hold lands (which expression in this notice includes houses, buildings, mines, minerals and easements in and over lands, and in, through, or over mines) for the purposes of the Railways and works to be authorised by the intended act, and for the general purposes of the Company and of their undertaking and works connected therewith and for providing increased accommodation the lands following all in the County of Denbigh, that is to say Certain lands in the Parish of Brymbo lying between the Railway Inn and the Company's Wrexham and Minera Railway, and adjoining that Railway, near to the junction between the branch to the Vron Colliery and the said Railway. Certain other lands in the same Parish on the western side of the Company's said Railway and adjoining thereto, and extending from a point about 3 chains northward of the said junction for a distance of about 6 chains in a northerly direc- tion. Certain other lands in the same Parish on the south-eastern side of the Company's said Railway and adjoining thereto, and extending from a point about 5 chains north-eastward of the post on that Railway indicating 41 miles from the junction of that Railway with the Shrewsbury and Chester Railway, for a distance of about 1 chain in a south-easterly direction. Certain lands in the Parish of Minera on the south-eastern side of the said Wrexham and Minera Railway, and adjoining thereto, and extendina from a point near to the post on that Railway indicating 5j miles from the junction of that Railway with the Shrewsbury and Chester Railway for a distance of about 14 chains in a south-westerly direction, To authorize the purchase and acquisition of part only of, or of an easement in, over or under any property which may be required to be taken for the purposes or in exercise of the powers of the intended Act without the Company becoming subject to the liability imposed by Section 92 of the Lands Clauses Consolidation Act, 1845. To vary, repeal, or extinguish all existing rights or privileges in any manner connected with the lands, houses, and buildings proposed to be pur- chased or taken, or which would, in any manner, impede or interfere with the purposes of the intended Act, and to confer other rights and Drivilpcffs. To authorize the alteration,diversion, widening, crossing, or stopping up of all roads, bridges, foot- paths, railways, tramways, aqueducts, canals, ferries, streams, and rivers, within or adjoining the aforesaid lands, and which it may be neces- sary or convenient to interfere with in the con- version and use of those lands and to provide that the company shall not be liable under Section 46 of the Railways Clauses Consolidation Act, 1845, to repair or maintain the surface of any road which shall be carried over the intended Railways by a bridge or bridges, or the imme- diate approaches thereto in all cases where the level of such road or approaches shall not be per- manently altered. To empower the Company on the one hand and the Shropshire Union Company and the London and North Western Railway Company (herein- after called the North Western Company ") or either of those Companies on the other hand to make, enter into and carry into effect, agreements and arrangements with respect to the purchase or lease by the Company, and the sale or lease by the Shropshire Union Company, and the North Western Company, or either of them, of the Pontycysyllte Branch of the Shropshire Union Company, and the rpaintenance, management, use, and working of the said branch, and the forwarding, interchange, and transmission of traffic on and over such branch, and the collection, payment, division, apportionment, and distribu- tion of the tolls, rates, and charges arising from such traffic, and to confirm or give effect to any Agreement which may be entered into for the purposes aforesaid, or otherwise to provide for such sale or lease, and to confer on the Company all necessary powers for making the said branch fit and proper for the conveyance of passenger traffic. To empower the Company to run over, work and use with their engines and carriages for the purposes of traffic of every description, and with their clerks, officers, and servants upon such terms and conditions, and on payment of such tolls, rates, and charges as may be agreed upon or settled by arbitration or defined or authorised by the intended Act So much of the Pontycysyllte Branch of the Shropshire Union Company as lies be- tween the termination of the intended Rail- way No. 1, and the commencement of the intended Railway No. 2. and to use the stations, booking offices, ware- houses, landing places, platforms, water, watering places, and standing room for engines and carriages, sidings, works, and conveniences con- nected therewith. To authorise the levying of tolls, rates, and other charges for and in respect of the use of the Railways to be constructed, acquired, run over, or used under the powers of the intended Act, and also for the use of the other works, conveniences, and accommoda- tion connected with the said Railways or to be authorized by the intended Act and to alter existing tolls, rates, and charges, and to grant exemptions from tolls, rates, and charges. To empower the Company and the Corpora- tions, County Councils, District Councils, Parish Councils, or Local Boards, or the owners of any roads or footpaths affected by the provisions of the intended Act, to make, enter into and carry into effect, agreement-. and arrangements, with respect to all or any of the matters aforesaid in which they are interested. To enable the Company to apply to the pur- poses of the intended Act, or some of them, such portion of their corporate funds as they shall think expedient. To alter, amend and extend or repeal all or some of the powers and provisions of the several Acts (local and personal) following, or some of them, that is to say, Acts relating to the Com- pany and their undertaking, viz., 5 and 6 Will. IV., cap. 107, and any other Act or Acts relating to the Company. Acts relating to the Shropshire Union Company and their undertaking, viz., 9 and 10 Tic., cap. 322, 10 and 11 Vic., cap. 121, and any other Act or Acts relating to that Company. Acts relating to the North Western Company and their Undertaking, viz., 9 and 10 Viet., Cap. 204, and any other Act or Acts relating to that Company. NOTICE IS HEREBY GIVEN, that applica- .1., tion is intended to be made to Parliament I in the ensuing Session, for an Act (in this notice called the intended Act "), for the following purposes, or some of them (that is to say) :— 1. To incorporate a Company (in this notice called 11 the Company "), and to enable the Com- pany to make and maintain the railways and other works or parts thereof hereinafter described, in the county of Denbigh, with all necessary approaches, sidings, stations, works, and con- veniences connected therewith (that is to say) :— Railway No. 1, commencing by a junction with the Wrexham, Mold, and Connah's Quay Railway, in the parish of Wrexham, at a point on that railway distant 12-5 chains, or thereabouts, measured in a southerly direc- tion along that railway from the southern face of the bridge carrying Mold-road over that railway at Exchange Station, and terminating in the parish of Ruabon, on the waste land between the vil- lages of Rhosllanerchrugog and Ponkey, numbered 650 on the — scale Ordnance 2:00 Map of that parish, at a point 9.5 chains, or thereabouts, measured due north from the centre of the road called Gutter-hill, from a point in that road live chains or there- abouts measuring in an easterly direction from the south-eastern corner of the Presby- terian Chapel. The said Railway No. 1 will pass from, through, or into the parishes, townships, or places of Wrexham, Broughton, Bersham, Esclusham Above, Esclusham Below, Rhostyllen, Ruabon, Ponkey, and Rhosllanerchrugog, or some of them. Railway No. 2, wholly in the parish of Wrex- ham and township of Esclusham Above, in the county of Denbigh, commencing by a junction with the Railway No. 1, in a field numbered 619 on the — scale 2.)(N) Ordnance Map of that parish, at a point in the north eastern corner of that field three chains or thereabouts from the easterly boundary fence thereof measuring at right angles to that fence from a point thereon five chains or thereabouts from its intersection with the stream at the north east corner of that field, measuring along that fence in a southerly direction and terminating by a junction with the Ponty. cysyllte Railway of the Shropshire Union Railways and Canal Company at a point on that railway distant 2-25 chains, or there- abouts, measuring along that railway in a southerly direction from the termination of that railway. 2. To authorise the Company, from time to time, to make and maintain, in connection with the abovementioned works, or any or either of them, all necessary and convenient stations, gates, approaches, transit sheds, bonding or other warehouses, sheds, quays, wharves, wharf walls, embankments, staiths, stairs, stalls, tramways, sidings, junctions, machinery, cranes, and other works and conveniences. 3. To deviate laterally from the lines and vertically from the levels in the construction of the said intended railways and works to such extent as may be defined on the plans and sections to be deposited, as hereinafter mentioned, or as may be specified in the intended Act. 4. To empower the Company to purchase and take by compulsion or agreement, and to hold lands, houses, and buildings, and easements for the purposes of the intended railways and works, and also to purchase and take in like manner for other purposes connected with their under- taking, and to hold certain lands and buildings, in the said parish of Wrexham, and the town- ship of Esclusham Above, lying immediately north of Hall-street, Rhosllanerchrugog, at the point where the said Pontycysyllte Railway crosses the said street, and to vary or extinguish all rights and privileges in any manner connected with such lands, houses, and buildings, or which would in any manner impede or interfere with the construction, maintenance, and use of the intended Railways and works, or lands or any of them, and to confer, vary, or extinguish, other rights and privileges. 5. To crotP, divert, alter, or stop up, whether temporarily or permanently all such streets, roads, highways, railways, tramways, canals, aqueducts, rivers, navigations, streams, pipes, watercourses, drains, and sewers, and telegraphic, telephonic, and other electric apparatus within or adjoining the said parishes and extra-parochial or other places, or any of them, as it may be necessary to cross, divert, alter, stop up, or otherwise affect or interfere with for the purposes of the intended railways and works, or any or either of them, or other the purposes of the intended Act. 6. To enable the Company to demand and recover tolls, rates, dues, or other charges for or in respect of the intended railways and works, and for the conveyance of traffic thereon, to alter existing tolls, rates, and charges, and to confer exemptions from the payment of tolls, rates, and charges. 7. To empower the Company or any other com- pany or companies lawfully working or using the railway of the Company, to run over, work, and use with their engines and carriages for the purposes of traffic of every description, including local traffic, and with their clerks, officers, and servants upon such terms and conditions, and on payment of such tolls, rates, and charges, as may be agreed upon or be settled by arbitration, as defined or authorised by the intended Act, the following railways, or portions of railways, or so much thereof as the intended Act may prescribe (that is to say) So much of the railway of the Shropshire Union Railways and Canal Company as constitutes the Pontycysyllte Railway of that Company. So much of the railway of the Wrexham, Mold, and Connah's Quay Railway Company as constitutes the Central Station at Wrexham aforesaid of that Company, and the railway between the said Central Station and the commencement of the Railway No. 1, herein- before described. So much of the railway of the Wrexham and Ellesmere Railway Company as constitutes the Central Station at Wrexham aforesaid of that Company and the Railway of that Com- pany between that station and the junction of such railway with the Wrexham, Mold, and Connah's Quay Railway. 8. To empower the Company to use the book- ing-offices, warehouses, landing places, platforms, water, watering-places, and standing room for engines and carriages, sidings, works, and con- veniences connected therewith or either of them. 9. To enable the Company to take and levy tolls, rates, and charges upon or in respect of the said portions of railways and stations so to be run over and used as aforesaid, and if and where necessary to alter or vary the existing tolls, rates, and charges which the aforesaid railway com- panies are new authorised to demand and take in in respect thereof. 10. To enable the Company to purchase or acquire by agreement so much of the undertaking of the said Shropshire Union Railways and Canal Company as constitutes the said PontcySllte Rail- way of that Company, and to authorise the said Shropshire Union Railways and Canal Company to sell the said railway upon terms to be agreed, and to confirm any agreement which has been or may be entered into for that purpose. 11. To enable the Company and the Shropshire Union Railways and Canal Company, the Wrex- ham, Mold, and Connah's Quay Railway Com- pany, the Manchester, Sheffield, and Lincolnshire Railway Company, and the Wrexham and Elles- mere Railway Company, the Cambrian Railways Company, or any one or more of them, to enter into and carry into effect and rescind agreements and arrangments for or with respect to the work- ing, use, management, maintenance, and con- struction of the intended railways and works, or any part thereof, and with respect to the supply of rolling or working stock, plant, and machinery, and the appointment and removal of officers and servants for the conduct and conveyance of traffic on the intended railway, and with respect to the payments to be made by or to the Company, to or by the said Companies, or any one or more of them, and the conditions to be performed in refer- ence to such working, use, management, con- struction, and maintenance, and with respect to the interchange, collection, accommodation, convey- ance, transmission, and delivery of traffic, upon coming from or destined for the respective rail- ways of the contracting companies, and with respect to the fixing of the tolls or charges to be demanded and recovered in respect of such traffic and the fixing, collection, payment, division, and appropriation, apportionment and distribution of the receipts arising from such traffic, or other the profits of the respective undertakings, and the payment of any fixed or contingent rent and to authorise and provide for the appointment of a joint committee for carrying into effect every and any such agreements as aforesaid, and to confirm and to give effect to any agreement which has been or may be entered into between the Com pany and the said companies, or any or eitli?er them, in reference to the matters aforesaid, or any of them. 12. To authorise the Company, notwithstand- ing anything contained in the Companies Clauses Consolidation Act, 1845, to pay out of the capital or funds of the Company, from time to time, interest or dividends on any shares or stock of the Com- pany during the construction of the railways or such other period as the intended Act may pre- scribe. 13. To vary or extinguish, extend or modify, all rights, powers, privileges, and jurisdictions, which are inconsistent with, or which would interfere with the objects of the intended Act, and to confer other rights and privileges. 14. And the intended Ast will incorporate with itself the provisions, or some of the provisions of the following Acts, or some, or one of them, namely, The Railways Clauses Consolidation Act, 1845;" "The Railway Clauses Acts, 1863 and 1869 -1 The Lands Clauses Acts The Companies Clauses Consolidation Act, 1845 The Companies Clauses Acts, 1863 and 1869." 15. To alter, amend, vary, extend, enlarge, or repeal all or any of the provisions (so far as may be necessary for the purposes of the intended Act) of the 7 and 8 Geo. IV., cap. 102, and any other Acts relating to the Shropshire Union Rail- ways and Canal Company, the 25 and 26 Vic., cap- 221, and any other Act relating to the Wrex- ham, Mold, and Connah's Quay Railway Com- pany, the Wrexham and Ellesmere Railway Act, 1885, and all other Acts relating to that Com- pany, 12 and 13 Vic., cap. 81, and any other Acts relating to the Manchester, Sheffield, and Lincoln- shire Railway Company, the 27 and 28 Vic., cap. 262, and any other Acts relating to the Cambrian Railways Company. 16. And notice is hereby further given, that duplicate plans and sections describing the lines, situations, and levels of the intended railways and works, and the lands, houses, and other property in, through, or over which they will be made, which may be taken for the purposes thereof, and an ordnance map showing the general course and direction of the intended rail- ways, together with a book of reference to such plans containing the names of the owners or reputed owners, lessees or reputed lessees, or occupiers of such lands, houses, and other property with a copy of this Notice, as published in the London Gazette, will, on or before the 30th day of November, 1895, be deposited for public inspection with the Clerk of the Peace for the county of Denbigh, at his office at Ruthin, and that, on or before the same day, a copy of so much of the said plans, sections, and book of reference as relates to each parish or extra-parochial place in or through which the said railways and works are intended to be made or within which any of the said lands and property intended to be taken are situate, with a copy of this notice will be deposited for public inspection as regards parishes, with the parish clerk and clerk or chairman of the parish council of each such parish, at his office or place of abode, and as regards any extra-parochial or other place, with the parish clerk and clerk or chairman of the parish council of an adjoining parish, at his office or place of abode.
