PURSU ANT to the above-mentioned Acts of t Parliament and the Consolidated General Order of this Court in that behalf, NOTICE IS HEREBY GIVEN, that on the 21st day of June, 1870, Sarah Roberts, of Bache Isaf, in the parish of Llangollen, in the county of Denbigh, widow William Geddes Smith, of Bache Isaf, aforesaid, gentleman, and sarah his wife; John William Maxwell Smith, of Bache Isaf, aforesaid, gentleman and Sarah Maria Smith, spinster, of Bache Isaf, aforesaid, presented their petition to the Lord High Chancellor of Great Britain, to be heard before his Honor the Vice-Chancellor Sir William Milbourne James, praying that an order might. be made vesting in William Overton and John William Maxwell Smith, in the said petition mentioned, or of such other persons as might be approved of by the Court, general powers for granting mining leases and leases of minerals of and under the farms and hereditaments mentioned in the heading of the said Petition, or any part or parts thereof, upon the terms mentioned in the 13th paragraph of the said peti- tion, and such other terms and conditions as to the said Trustees should seem fit, and to enter into all necessary contracts for the same, such leases to be in conformity with the provisions of the several Acts of Parliament mentioned in the heading of the said petition, and to be subject to such other conditions as his Lordship might direct. 2. That for the purpose of extending the said powers, and for the purpose of setting aside and of duly apply- ing according to the provisions of the 1st of the said Acts the rents and payments reserved on any of such Leases, the said William Overton and John William Maxwell Smith, or such other persons as might be ap- proved by his Lordship, might be appointed Trustees, with liberty for any person interested under the Will of the said Testator, John Roberts, in the petition men- tioned, in case of the death or incapacity to act of either of them, to apply to the Court for the appointment of one or more persons to act as Trustee or Trustees in his place, with all the powers and duties of the Trustee so dying or becoming incapable of acting. 2. That the costs of the petitioners and all other per- sons served with anct properly appearing on the said pe- tition of and incident to this application and consequent thereon, might be taxed as between Solicitor and Client, and the amount thereof, when certified, paid by the pe- titioners in the first instance, but that the said William Overton and John William Maxwell Smith, or such other persons as aforesaid, might be ordered to repay such amounts to the petitioners out of the tirst moneys which they should receive by way of royalties under any lease which they might make under the said powers, or that his Lordship might make such other order in the premises as to his Lordship should seem fit.
