The business' had been carried on 1'1' some years, with Mr. Wheeler as iheir ajuit or direc: or, whv, in January, 1850, gave plaj¡t;¡r onltr8 for some getrng to bo done for the tilting ot machines which he had pr,,i?,u,)y been supplied with, at l'eii- ititielino. Tli! y were uii i,y according to tJw express orders of H: director. Several rln1S of money had been paid by the company for work donc hy his client, p.nd he conceived that the only de" fence which his learned friend might make would be. that the goods supplied were not of such a quality as would justify th,jemund, but proof of tli" good work- manship and the good quality suppiid would be ad- ducen. If the defence was nn setup \1 pon the grounds that the lOQrI were not supplied to the new company, he oLI,l bring sufficient evidence to prove that they were supplied lifter the new company was registered, ..d that no notice WtS given of the alteration or change in the name ot the com pan-, and that whether new or old, the p.sent cOlJlrny had the benefit of the I ph.ir.tiirs goods. He had r.o doubt but that the Jury, by their verdict, would deel-ire that those wlw had tl,c benefit of such goody ought to possess sufficient honesty and justice to pay for them Mr. Coxon produced the date of the rcgistration "r the C,' which was (he 10th ot February, H'.jO Iii?l,d the plai.,tifl, sa?', he was an j¡,nn.to\:LHler and engineer at Eangor, and that he rc. ceived crderc from Mr. Wheel, r, the manager and di- rector of the Machno Sla'e and Slab Company, for se- construction of fly wheels, sawing machines, and g. ar- iug, whiehw'ere snipped to Conway,th,- aggregate amount for tlie goo Is supplied being 1273 7s .Vi. Rollers were also itnid- for ihem, c-mvey. d ajd pift up at their quarry at Penmachno, and answered their purposes. C,css-ex*:nined by Mr. M. Lloyd—Sent the com- pany the bill produced. Received orders for the con- of the machines, on the Uth Aug^ust. 18o5 —delivered the gearing in February liSMi. Abont a month weeks e'apaed y were deli- vend. Did not agree t at the saws or gearing should be made to the satisfaction of Mr. Spooner. He was told by Mr. Wheeler to go to Mr. Spooner to ascertain whether they pleased him. Tne latter gentleman said he would have nothing to do witn it, as Mr. Wheeler had the whole management of the concern. I{ncw nothing of the Machno Slab Company, except that which Nir. Wheeler represented. Received payment at different times by hilis of exchange. The fir.,t was returned, but the others were not. No one but Wheeler said they were defective. In March itti,7, went up to the quarry in company with Mr. J. F. IIiigi.es, and saw the machines ut work. L.st Monday went there ajain in compcny with Messrs. Bernard and Harrison. Did not knuw when the different entries weie lIIade in the books, us they were kept by his brother. The cause of the change of the name from the -old to the new company, ho presumed tc be his having seen the title of the company over a door at the 1:,laII'Y.- [Upon a question being put as to what he IlUd state,I to liis attorney concerning this coaipanv, learned argu- ment* wpre excbaaed between the advocates on but.) s ides as tu thu privilege of communication between atto.'ney and elieut J Hal some conllnllllicntion with his attorney concerning an aflidavil made in London. Re-examined by Mr. M'lntyre —Engaged to con- struct two machines, which came to £ 107. Received t67 as payment. Wheeler continued Di- tector ns long as he (plaintiff) continued to supply the company with goods. Thomas Griffith, the plaintiff's clerk recollected re- ceiving in July, 185(J, the sum of J:J"O"n account, of the machinery done. Wheeler made nn complaint to him about them. Forwarded 12 waggon wheels him- self to Pe"ma"ll1Io, ¡ CrosB-txamined—Remembered having seen some letters about the defective scute of the machinery. The reason he mide two entries of the some articles was that the prices was altered. The change was not done after the action was enterel. W. Jone. said he worked at the Penmachno Quarry as stonemason for lo months. Saw the machinery at work—did not hear of any complaint being made con- cerning them. Croos-cxaaiinfd — Was a sti)nenitson--saw slabs cut both ways. Had nothing to do with the machinery. t?wtand Jones was enRn?cd by Gr.nuh in the 6?i.? up of the achi '.9' No complaints were ti?e?? made to him as to their dtf,,ti?. tate. 3.. so.?e time afterwards hut they were not in working order in consequence of the foundation having given way. Mr. J. Frederick Hughes -aid he went up to inspect the machinery in March, 1857. They were then in good working order. 'I'he charges in the bill produced were very moderate. Mr. Robert Harrison, said he was the manager of Colonel Pennant's slate-factory at Bangor. Had paid considerable attention to machinery. Went to the Company's works on Monday. Inspected the different machines useithere. They did not appear to him to work well, in consequence of their being used to pur- poses which they were not iiiteided for. The found- ation was very bad. Cross-examined—Tliey were then used for cutting off the ends of the slabs,-the saws were badly strung— no doubt but that liiiiiselfor workmen could produce far better articles from the machinery-the men there did as good a work as might have been expected for the wages they got. lr. J. Bernard said he was an engineer at a lime quarry near Conway. Went to the Pemriaebno Quarry on Monday, and agreed with what the last wit. ness said. Did not see the machinery at work, as they gave up working when they got there. Cross-examined—Knew of machinery in general- cannot make slttes out of lime, and never tried. Mr. Morgan Lloyd was about addressing the jury in defence, when His Lordship suggested the propriety of both par- ties agreeing to refer the whole matter to a skilled arbitrator, in order to do which, they would hate to avoid all technicalities, to present the case in a simple j tnannei and k« thnt ?""?' -'o?er ?. «"*ht h1, Cu dec:dc whether ('nlJl?h l.nd b. en raid for the kind ot machinery supplied to ?'te'n'dant' '?
