Llanelly Man's Appeal. LEGALITY OF THE JUDGMENT CALLED IX QUESTION. I. In the Court of Criminal Appeal on Thurs- day, before the Lord Chief Justice and Jus- tices Darling and A. T. Lawrence, a curious point was raised in an appeal by John Smith against his conviction and sentence at Car- marthen for housebreaking at Llanelly. The Chairman, it appeared, sentenced the man to three years' penal servitude, to run consecu- timely with a remanent of a previous sentence, the prisoner having been out on licence. It was contended that the sentence was illegal in the form in which it was passed, but the Court held that the. words to run conseeu- j tively" mere surplusage, and struck them out, the sentence of three years' penal servitude to stand. The remanent of the pre- vious sentence would be dealt with hereafter as the Home Secretary might determine.
