Morgan jon<s, fonneriy of Rhuadymott Farm, and now of Penybank, Golden Grove, applied for an ejectment order againtt — Thomas, Bankyrodyn. Mr. G. C. Porter was for applicant, amd Mr. T. C. Hurley d&fended. Applicant said he gave up the farm on the death of his wi)fe, as his own health had become affected. Bankyrodyn comprised a house and garden, at the annual rental of ;E 12. The garden had not been put by the present for years, and the &urrounding fence was ruined. The kitchen of the house had been used for rearing chickens. Mr. Hurley asked if he wished to seriously suggest that Mr. Thomas reared chickens in the kitchen. Witness: Yes, before I gave him the out- buildings. He admitted that he had not since seen the chickens in the house. He did not suggest that he had committed any I damage to the place apart from his neglect in keeping it in better repair. The garden was overgrown with grass, weeds and thorns, and WM a wilderness. The furniture was stored in a mined cottage at Penybank, and rain could came through the roof. The Chairman said he knew the cottage had been used tor storing coke. There coold be no doubt that the furniture would be Turned if kept there for six month:. Mr. Hurley put it to the applicant that he had been offered a considerable turn of in- going money on leavi ng Rhuadymon. The Chairman intimated that would ha (e no bearing on their minds. Mr. Hurley eubmitted that applicant had not proved letting or ownership. Neither had he proved that the premises were reasonably required by himself, or that waste had been committed. Condwen Annie Thomas, daughter of defendant, said her father worked away from home. In 1916, an arrangement was made at to quitting the house. She and not her father made all the arrangements. In cooee sequence of that they looked for anothet house. Mr. Evans, J.P., LIajMtephan, came to the house, and told her that there wa< a now owner, and that they would have to leave. Her mother looked for another house. After that, Mr. HoweII Davies, solicitor, Carmarthen, wrote that they didn't want them to leave the house on the 29th Septem- ber. The houae they had taken was then abandoned', and they remained on. Notice to quite was received in September, 1917, with the intimation from Morgan Jones that he required It on account of hit wife' s til- health. They were eight m family. One brother was in France since the outbreak of war. Her mother was an invalid. Her three brothers came home on several occamoM during the year. Her mothef wutfered from rheumatism, and was unable to leave the house. Any excitement made her very weak and affected her nerves. She was not in a fit condition ho leave the house. She had made enquiries for another home. Le«er< were put In in regard to house* concenimg which she had made enquiries. By the Bench: We have done our beet to rind a bouse. The house suggested at Ghn- rhyd by Jones was not fit to live in. The last tenant left m consequence. It WM act half the size of the present house. The Chairman said the applijcatlom LtHed. Mr. Porter said that his client had given up possession or h& farm to go Into bit own house. The Chairman said if he couM dttptove anything, they would hear him. They could not turn a family like thit on the Mad. Cross-exam Ined. witness said they wece nve always at home. Morgan Jooea had <oe- gested two houses that they could p) to. Neither was In a good state of repair. A house smaller than the present one woujd not suit them, as they had grown up, and decency had to be observed.
