(Incorporation of Company; Powers to Construct Railways in Counties of Cardigan, Montgomery, and Radnor Deviations Compulsory Purchase of Lands; Powers to Levy Tolls and Rates; Payment of Interest out of Capital during construction Power to limited owners and others to sub- scribe Running Powers over Rail- ways or parts of Railways of the Manchester and Milford Railway Company, and the Kington and Eardisley Railway Company; Working and other arrangements with the Great Western Railway Company, the Man- chester and Milford Railway Conpany, the Leominster and Kington Railway Company, and the Kington and Eardislev Railway Company Amend- ment of Acts). NOTICE IS HEREBY GIVEN, that application is intended to be made to Parliament in the ensuing Session for an Act (in this Notice called "the intended Aot"), for the following purposes, or some of them (that is to say):— 1. To incorporate a company (in this Notice called" the Company "), and to enable the Company to make and maintain the railways and works or some part thereof hereinafter described, with all necessary approaches, junctions, sidings, station*, works, and conveniences connected therewith (that is to say) :— Railway No. 1, commencing in the Parish of Aberystwyth, in the County of Cardigan, by a junction with the Manchester and Milford Railway, at a point 30 yards, or thereabouts, meat-ured along that Railway in a north- easterly direction from the north-eastern abutment of the bridge which carries that Railway over the River Rheidol, and terminating in the same Parish and County at a point in the south-east boundary wall of the Board Schools in Smithfield Road, 48 yards, or thereabouts, measured along that wall in a north- easterly direction from the centre of the said Smithfield Road. The whole of the said Railway No. 1 lies within the Parish of Aberystwyth. Railway No. 2, commencing in the Parish of Llanilar, and in the County of Cardigan, by a junction with the Manchester and Milford Railway at a point thereon opposite to the East Corner of the Signal Box on the South West side of Trawscoed (Crosswood) Station on the said Manchester and Milford Railway, and distant about 77 yards or thereabouts, measured in a Southerly direction along the said Railway, from a level crossing which passes across the said Railway and leads to a farm-house known as Heiulre-Rhys, and terminating at New Radnor in the Pariah of New Radnor and County of Radnor, by a junction with the termination of the New Radnor extension of the Kington and Eardis- ley Railway. The said Railway No. 2 will be made in or pass from, through or into the Parishes and other places following, or some of them (that is to say) —Llanilar, Llanafan, Lower Gwnnws, Upper Llan- fihangel-y Creuddyn and Cwm Rheidol in the County of Cardigan; Llangurig in the County of Montgomery St. Harmon, Llansaintffraid Cwm- deuddwr, Nantmel, Rhayader, Llanfihangel Hely- gen, Llanbadarn-Fawr, Ll&ndegley, Llanfihangel- nant-Melan, and New Radnor in the County of Radnor. 2 To authorise the purchase and taking of the following pieces of land, which are, or are reputed to be common or commonable lands, viz :— Description of common Area estimated or commonable land i £ mit „f required to and the name of be taken not deviation the parish. about. exceeding. To deviate laterally from the lines and verti- cally from the levels in the construction of the intended railways and works to such extent as may be defined on the plans and sections to be deposited as hereinafter mentioned, or as may be specified in the intended Act. I 4. To empower the Company to purchase and take by compulsion or agreement, and to hold lands, houses, and buildings, and easements for the pur- poses of the intended railways and works, and to vary or extinguish all rights and privileges in any manner connected with such lands, houses, and buildings, or which would in any manner impede or interfere with the construction, maintenance, and use of the intended railways and works, or lands or any of them, and to confer, vary, or extinguish other rights and privileges. 5. To cross, divert, alter, or stop up, whether temporarily or permanently, all such streets, roads, highways, railways, tramways, canals, aqueducts, rivers, navigations, streams, pipes, watercourses, drains, and sewers, and telegraphic, telephonic, and other electric apparatus within or adjoining the said parishes and other places, or any of them, as it may be necessary to cross, divert, alter, stop up, or otherwise affect or interfere with for the pur- poses of the intended railways and works, or any or either of them, or other the purposes of the intended Act. 6. To enable the Company to demand and recover tolls, rates, dues, or other charges for or in respect of the intended railways and works, and for the conveyance of traffic thereon, to alter existing tolls, rates and charges, and. to confer exemptions from the payment of tolls, rates and charges. 7. To authorise the Company, notwithstanding anything in the Companies' Clauses Consolidation Act, 1845, contained to pay out of the capital or funds of the Company interest or dividends on any shares or stock of the Company, during the con- struction of the intended railways. 8. To empower the Company or any other Com- pany or Companies lawfully working or using the railways of the Company to run over, work, and use with their engines and carriages for the purposes of traffic of every description, including local traffic, and with their clerks, officers, and servants upon such terms and conditions, and on payment of such tolls, rates, and charges, as may be agreed upon or be settled by arbitration, or as may be defined or authorised by the intended Act, the following rail. ways, or portions of railways, or so much thereof as the intended Act may prescribe (that is to say): So much of the Railway of the Manchester and Milford Railway Company as lies between the junction of the intended Railway No. 2 at Trawscoed, therewith, and Aberystwyth. So much of the Kington and Eardisley Rail. way as will be situate between the janction therewith of the intended Railway No. 2 and the New Radnor station of such railway including that station together with all stations, roads, platforms, points, signals, water, water engines, engine sheds, standing room for engines, booking and other offices, warehouses, sidings, junctions, machinery, works, and conveniences of or connected with said portions of railways. 9. To enable the Company to take and levy tolls, rates, and charges upon or in respect of the said portions of railways so to be run over and used as aforesaid, and if and where necessary to alter or vary the existing tolls, rates, and charges, which the aforesaid railway companies are now authorised to demand and take in respect thereof. 10. To empower the Aberystwyth Improvement Company, Limited, and other Companies or persons to subscribe to and hold shares or stock in the capital of, or to lend money to, the Company for the purposes of the intended Act or any of them, and to contribute towards the costs, charges, and expenses of the promotion of the Bill, and to appoint persons to be members of the Board of Directors and to vote at meetings of the Company. 11. To authorise trustees and owners of settled estates and others to contribute towards the cost of the railways and works of the Company, and empower owners, trustees, tenants for life, and other persons under any disability, whose estate or any part thereof may be benefited by, or any part of whose lands may be required for the railways and works of the Company, to sub- scribe for and take and hold shares in the capital of the Company, and to charge their respective estates with the amount so contributed or sub- scribed. 12. To enable the Company and the Great Western Railway Company, the Manchester and Milford Railway Company, the Leominster and Kington Railway Company, and the Kington and Eardisley Railway Company, or any one oc more of them, to enter into and carry into effect
