COLWYN BAY WATER SUPPLY. LLANDUDNO COUNCIL'S HEAVY CHARGES. A PROTEST AGAINST AN INEQUITABLE DEMAND, A special meeting of the Llandudno Urban District Council was held on Monday evening, mainly to con si dor the question oi supplying water to Colwyn Bay. As already reported in the "Pioneer" the CowJyd Water Board, who are responsible for Colwyn Bay's water supply have failed to com- plete the work of laying the new main, which is to provide additional water for the town, by the time originally arranged, and in order to help the Colwyn Bay supply pending the com- pletion of the work, the Llandudno water main has been tapped in accordance with an agree- ment between the Cowlyd Board and the Llan- dudnc Urban District Council. The point be- fore the Council now was whether the price of £ 10 pea- day charged for the water thud sup- plied to Colwyn Bay under the terms of the agreement should be reduced, having regard tor the fact that only one-twenty-seveuth of the amount of water menioned in the agreement was actually supplied. In the abjortoo of the Chairman (Mr W. H. Jones), Mr T. W. Griffith was voted to the chair. There were also present Messrs R. Rl- borts, J. McMaster, II. Wilson, J. O. Thomas, T. Smith, D. Davies, Wm. Thomas, Pierce Jones, Hugh Edwards, E. E. Bone, W. Beau- mont, with the Clerk (Mr A. Conolly), and tho Deputy Surveyor (Mr Ward). There were thus only twelve out of the sixteen members of the Council present. At the outset the Clerk read a report of a special meeting of the Council's Gas and Water Committee, who had met a deputation repre- senting the Cowlyd Water Board on the mat- ter. From this it appeared that I he agreement entered into between the Board and the Coun- oil in 1899 had been considered, and that the Deputy Engineer to the Council (Mr Ward) had reported that only one-twenty-seventh of the full bore of the six-inch pipe mentioned in the agreement had been supplied to Colwyn Bay. The committee thought it would be only rea- sonable to both parties that the E10 charge cited in the agreement be under the circum- stances materially reduced, and they recom- mended that the charge be at the rate of L5 per day of 24 hours. A POINT OF ORDER. Mr McMaster, who declared he meant to take every legitimate step to thwart the com- mittee's designs in that matter, submitted at this point that under the standing orders of the Council the committee meeting referred to had been entirely illegal, because it was an extra- ordinary meeting, of which no mention had been made in the list list of committee meet- ings provided at the OOlnmencelllent of the year under the Council's instructions. He con- tended it was incompetent for members of tho Council to hold such a meeting, and to discuss a question of alvogating an agreement made with another authority under seal nine ox ten years. Under the circumstances he held that the whole proceedings were null and void. In reply to the Chairman, The Clerk said he failed1 to gather any rea- sons from Mr McMaster's statement why the proceedings should be null ana void. Mr McMaster enlarged upon his argument, but The Clerk repeated that the procedure had been quite in order. The Chairman added that the procedure had been the same as usually adopted in regard to special committee meetings. As they were all awa.ro at the monthly meeting of the Council on the previous Wednesday that question had been brought up, and the committee had been requested to meet the deputation from the Coiwiyd Board to discuss it —— Mr Bone (interposing): The only point is, Mr Chairman, whether this meeting was in order. Let us have your ruling on that point. Mr R. Roberts: If Mr Bone is in a hurry to leave lie can do -,o; but surely he should give the Chairman an opportunity to give his views. Mr Bone said he had no desire to prevent the Chairman speaking. Mr R. Roberts: The Chairman has had suffi- cient experience to know when to stop talking. The Chairman: Then I rule that the pro- cedure was in order. Mr Bone: Hear, hear. In reply to Mr R. Roberta The Chairman (who is also chairman of the Water and Gas Committee) said that in his opinion the Council were bound under their agreement with the Cowlyd Board to supply for the R10 charge specified a supply of water that would fill a .six-inch pipe in the ordinary way. Consequently the committee maintained that in fairness to their neighbours of Colwyn Bay and those connected with the Water Board they should meet them amicably as regards the prioe. Mr Bone: Hear, hear. At Mr McMaster's request the Clerk read that part of the agreement which dealt with this particular point. Thereupon Mr McMaster urged that the water should only be supplied in an emergency and for two days only. Mr Bone: I take it that, if in the opinion of the Engineer we could supply water to the full oapacity of a six-inch pipe without imperilling our own supply, we would be obliged to do so at the cost of JBIC per day. The Clerk replied in the affirmative. A MATTEn OF EQUITY. Mr Bone: Then seeing that we are only sup- plying one twen t.y -seventh instead of twenty twenty-seven i hs of the capacity of this pipe it is merely a matter of equity in my opinion that we give the water at the reduced charge. Con- tinuing, Mr Bone asked whether it was rea- sonable as between man and man or between two neighbouring authorities for them to do otherwise, seeing that they were not supplying the quantity asked for by the agreement. They should treat Colwyn Bay people as neighbours, and do to their neighoburs as they would that neighbours should do unto them (hear, hear). One of the first) rudimentary qualifications of a public man to fill his office was tnat he should treat his fellow-citizens and other authorities as ho or his own Council or board should be treated. He thought the Llandudno Council should welcome that opportunity to show their goodwill to Colwyn Bay. What benefited Col- wyn Bay must benefit Uandudno, just as what- ever benefited Llandudno would benefit Colwyn Bay. It would be inequitable to ask for more t,hantheL5p,ar day suggested by the committee, and he, therefore, moved that that be ap- proved. Mr McMaster raised another point of order as to whether a seven days' notice should not have been given of that meeting. The Chairman: I rule that it did not re- quire a seven days' notice under the circum- stances. Mr McMaster: Is there any written re- quest for this amendment of the agreement ? The Chairman: The fact that the deputation met our committee and discussed the matter with them was sufficient without a written re- quest. There is no written request about that but there is a written request as to the supply of water. Mr Bone: And that is aJI we want. Mr W. Thomas said that the very fact that Colwyn Bay had accepted the water from Llan- dudno made them liable to payment at the rate of £10 per day. Mr R. Roberta suggested that a little more information be given concerning the negotia- tions in committee, and remarked that as they had not had the, opportunity to thrash out the whole thing in detail in committee they would he voting without possessing desirable informa- I tint. < The Chairman: If you wish to ask for aul, information with regard to the agreement 4* anything else the Clerk will be very pleased 14 give it you. Mr W. Wilson asked whetheur the pressure of water was increased or affected by granting thf water to Cohvyn Bay, and also whether it wag; a fact that severat complaints had been rcfr oeived by the Council recently concerning « scarcity of water in the higher levels of Llaifc dudno. ONLY ONE COMPLAINT. The Chairman: Only one complaint ha3 beaaj reoeived in the office. A similar complaint weA received last year from the very same person* so that the fact that we are supplying this small quantity to Oolwyn Bay has not affected thfli upper regions of our district. Mr Wilson: But you have personally received complaints through me. Th-e Chairman: You are better able to aDoo swer that question than me (laughter). Smith seconded Mr Bone's motion,, and said he thought that at JB5 per day Llan.. dudno would be making a good bargain, see-i ing that they were supplying merely one-.wonty* seventh of the quantity for which they wculd 14 entitled to L10. Mr D. Davies moved as an amendment that the recommendation of the committee be not adopted, because he thought the Council had no moral or legal right to sell the water at the price suggested. He did not think that was a bargain which any cif the councillors would strike if the affair was their own rather than that of the public generally. The ratepayers of Llandudno were called upon io pay Is 6d per 1000 gallons for their water, but if the re- commendation of the committee were adopted they would be selling wholesale to Colwyn Bay, at the rate of 9d per 1000 gallons, thereby giv- ing Colwyn Bay an opportunity of selling Llaiv dudno water at a profit—an unfair and unreal sonable business. As to the quantity supplied being less than demanded by the agreement, thoy gavo Colwyn Bay as much as they neodoa and when they opened the Llandudno valve to the full it burst the Cowlyd Board's pipe, so that it w a.-I to tho Board's advantage not to have the full capacity of the jjite. He had nq doubt but that the work injured the Llan- dudno supply, for there were many complaints of scarcity of water on the Orme's Head. IF THE BOOT WERE ON THE OTHER LEG Mr J. O. Thomas: Supposing we were to, suffer from a shortness of water at this time would the agreement compel the Cowlyd Board to supply us with water under the same cir- cumstances ? Is the agreement the same on both sides. The Chairman: Yea, certainly. Mr McMaster said that if Llandudno could supply Colwyn Bay with 150,000 gaUons of; watea- now at the height of the season with- out imperilling its own supply there was noti tflhe slightest reason to spend the large sumit proposed upon the extension of the new main pipeline to Llandudno, and if the committee's recommendation were adopted he would con-i sider it his duty to attend the liccal Govern rwont Board inquiry concerning the loan for that work, and object to the Council's application' Supposing a fire broke out at Llandudno what would be their position? The whole place might be burned down (laughter). It was al. very well to talk about neighbourliness, but "self-preservation was the first law of riatuxer, (hear, hear, and laughter). Continuing, the speaker dwelt upon the large expenditure on the Llandudno water works and the small re- venue from them, and concluded by saying he felt confident that if OoJwyn Bay were in that position of Llandudno Colwyn Bay would not accede to such a request. "If, however," saici Mr McMaster, "they can have the water with- out imperilling our own supply let them havfil it." Mr W. Thomas also spoke against the coatt: mittee's recommendation. Mr Ward said he had made every endeavour to earn tho money offered by the Cowlyd Board without in any way imperilling the Llandudno supply. He was satisfied that their supply had never been in danger, and would promptly take measures to meet it if danger, threatened. Mr Ward added that he was abo satisfied that the pressure at Llandudno af night-time was reduced by no more than ontii pound while the water was sent to Colwyn Bay. He would be glad to answer any question that could be put to him. Mr Pierce Jones, who also opposed the re- commendation, remarked that he had not for* gotten the action of Colwyn Bay over tha sewerage scheme when Llandudno were forced to pay £953 lis 6d, wnich they would never otherwise have paid. Mr R. Roberts said the £10 charge was tb6 minimum fixed at a time when Llandudno were in possession of a plentiful supply of water, but, though they were now on the borders of baoorning possessed of a practically illimitable supply, the present was not the time to give water to anyone. Mr Beaumont said there were plenty of wealthy people at Colwyn Bay-mlrs Bar Barnato and a hoot of other millionaires—who would readily contribute towards the extra ex* pence if they were appealed to (laughter). The Chairman said the deputation had re- minded the committee that on a previous oo- oasion the Council had supplied the Board with water at the rate of 4d per 1000 gallons, and they now offered 6d, but the committee reoom-i mended the charge of f,5 per day, which they thought reasonable to both parties. He though6 it would be unjust, unfair and unneighbourly, to charge the full amount under the circum- stances. After some further discussion the question; was put to the vote, but only Messrs Bone, Smith, and the Chairman supported the com*; mittee's recommendation, all the others re- cording against it. The Cowlyd Board willr therefore be called upon to pay £10 per day, for the water supplied.
