ROYAL COURTS OF JUSTICE, Wednesday, 1st March, 1893. Before Mr JUSTICE ROMER, The ATTORNEY-GENERAL (at the relation of the Ystradvfodwg Lo al Board) v. THE YSTRAD GAS AND WATER COMPANY. JUDGMENT. Mi JUSTICE ROMER The Plaintiff in this action seeks relief on the ground that the Defendants have been supplying -water polluted with sewage matter which i" dangerous to health. Few things are of so much importance to a district as •a supply of good water, and personally I should be in- •clined to take a very strict view with regard to the parity of the waU-r required for drinking purposes. I am lad to hv ascertained from the evidence which •has been givui in the case before me that the Defen- dants cannot properly be ch<1rgect. wilh snpplying water in any way polluted or in any way dangerous to health. Th" evidence adduced by the Plaintiffs was in itself wholly insufficient to suppeit the action. At tLe most it only raised a. case of suspicion that some pollution might geu into some of the water formill one of the several sources from which the Defendants get their water supply, and it might ?et there before it was filtered. No evidence whatever hatt been given of pollution or as to the bad quality of the water, in fact, supplied, with which alone I am concerned, and I might on this* ground alone have dismissed the action without calling on the Defendants at all i but seeing the importanc of the matter to the district, and the desirability of not allowing any suspicion ever to remiin if possible I thought it right to let the Defendants give some evidence, more especially as their Counsel stated (and, as it appears to me, rightly s: a ted) that they could show that there really i" no true or sufficient ground whatever for the suspicioll as to the purity of the water supplied by them. I aiM satisfied on the evidence not only that the Plaintiffs' case fails, but that the water supplied blj the Defendants is remarkably pure and free from any pollution, and not dangerous to health, and that, in fact, it is one of the best waters supplied to any District in the Kingdom. In the result this act-ion will, I hope, e enough to satisfy the mind;, of the people iu the nelghuourhood as to the quality of the water, and perhaps the trial of this action may not have been a useless enquiry.
