THE GREAT ORME TRAGEDY
THE GREAT ORME TRAGEDY POLICE COURT SEQUEL. The tragedy which occurred on the night of October 8th, at Brynygwynt Ter- 0 race, on the Great Orme had a sequel at Llandudno Poliae Court on Monday, when Councillor Walter Beaumont, licensee of the King's Head Hotel was charged with permitting drunkenness. Mr J. J. Marks appeared for the police and Mr RI. S. Chamberlain for the de- fence. Mr Marks, opening the case, said a man named Curwen was seen by his wife about half-past six on the Saturday even- ing at the Royal Oak Hotel, in Lower Mostyn Street, and she would say that he was at that time drunk. After he had followed her up Mostyn Street she missed him and found him again at the King's Head. He was then undoubtedly drunk and had two glasses -of beer there. George Brookes was called, and said he knew Curwen, whom he saw at the King's Head on Saturday night, October 8th. He had two glasses of beer with him, but was not certain who served them. Mr Marks: What was Curwen's condi- tion ?-He, was not drunk. Was he sobers—Not exactly sober. He wa,s capable enough in my opinion. What time was this ?-,Between eight and nine. Mr Chamberlain Was there anything about Curwen to put Mr and Mrs Beau, mont on their guard?—'Not in my opliallon, sir. While you were there did not Mr Beaumont refuse to serve a man and tell him to clear out?-Yes. Was that while Curwen was in the house?-Yes. James Coburn, tram conductor, said he first saw defendant by the Black Gate. Mr Marks: What condition was he in? —I thought he was drunk, What made you think, so ?,He was using bad language and swaying from one side to the other. Cross-examined by Mr Chamberlain, witness said he had never noticed that Curwen wa/ked in a peculiar manner. Mrs Leathley deposed she saw a manhy the, Black Gate the worst for drink. George Brookes, re-called, said Curwen had no wound on the head when he left him by the Black Gate. Mrs Curwen said she saw her husband at the King's Head on the Saturday night with a glass of beer before him, but could not state the time exactly. It would be eight or more. Before that she had seen him at the Royal Oak about half- past six. He was drunk then and follow- ed her up the street using bad language. He never used such language when lie was sober. He had given her no money that day. In reply to Mr Chamberlain, witness denied that her husband- had offered her a sovereign and that she Was in the habit of ha,ving too much: to drink. Mr Chamberlain submtted that if it could be proved that- his client had taken all reasonable precautions to prevent drunk- enhess there could be-no conviction. It had been admitted that Mr Beaumont, had ordered one man: Gut of the hotel while Curwen was there. Further there was no proof that Curwen wa.s drunk, and he was in ai position to prove that he was sober when he left the Royal Oak that evening, James Mellor, gardener, in the employ of Mr S. Hall, said he worked with deceased for eight months. On the Satur- day evening in question he and Cur-wen were, engaged in planting trees on the verandah at the Roy] Oali:, until after seven. Curwen was perfectly sober when he left. They only had one glass of beer. Mrs Curwen's statement that her husband was drunk was an absolute lie. Cross-examined by Mr Marks, witness said deceased had only one drink that he knew of. He could not say whether he had any when carry ing the trees upstairs. I He asked him if he had a drink, and he said "No." William O'sborne, gardener, said that Curwen was not druhk when he came to the King's Head. He knew Mr Beau- mont looked after his business carefully, and had seen him refuse persons whom he (witness) thought might have been served. In reply to Mr Marks., witness said he. could not say that Curwen was absolutely sober—but he was not drunk. Mr Beaumont caflecl to give evidence on his own behalf said he saw Curwen come in and supplied him with two glasses of beer. His condition was then such as: he could have taken another ten and then walked up. He was absolutely sober, and what drink he had had no more affects ed him than a lint of beer with his din- ner would have done. There were many persons whom he would not allow in the house a,t all, drunk or sober. He had refused to serve one man while Curwen was in, and he challenged the police to say his house wa's not adnvirabf y conduct- ed. In reply to Mr Marks,, defendant said his ,experience was woridrwide, and if he could not judge when a man was drunk there was not another man in the world who could do so. Curwen might have swayed at the, Black Gate. Scarcely any- one went up there, at that time without the "Sunday Closing" in his pocket, and the chances were that it never got home. —(Laughter.) They would drink it out- side his house. Mrs Curwen had two or three glasses of stout ip the bottom bar. She had more to drink in his house than her husband. The magistrates retired to consider the case, and after a while called in the c'erk (Mr Porter). On their return the Chairman said the case would be rdjourned for one month. Mr Marks: Does that mean that the case will have to be: re,-heard. The Chairman Yes, we are equally divided. Mr Chamberlain Then it's very hard on my client. That's all I can say.
