The Motor Car Collision,
The Motor Car Collision, JUDGMENT FOR PLAINTIFF. In the case of Jenkins v Woodhead, brard by Judge Moss at Rhy!, aid recently reports d by in-, his Honour has given judgment in writing as follows In this case the plaintiff is the Ri>ctor of St. George. near Rhyl, and the defendant is a gentle- man residing at Chesterfield. Bjth the plaintiff and defendant are the owners of a motor car. On the 24th of May last the plaintiff, havirc his wife and her sister and cousin in thi- car, w,is driving from St George to Rhyl. The defen- dant's car was being driven from th direction of St Asaph to Abergele, the occupants being two gentlemen and the chauffeur; and a the point where the roads eras", each other the crs collided, the plaintiff's car being seriously d-miag d, but fortnntely rone of the occupanln of either cir were injured. The plaintiff allege? t h. c llision was dne to the negligent driving of tih- defen- dant's car, and claims from thiJ drfrndant X29 (id by way of damages. Thy defendant on the other hand contends that the plaintiff was to blame, and connter-claima the sum of L- 14s 3d for damages done to his car by the collision. The pi»iotift in his evidence,and h" is cotroborated by all the rc npants of the car, alleges that when I within eighty yards from the cross-roads he sounded his hooter, and kept pounding it until the collision. On his right was a high wall, eight feet high, so that the occupant of nun ear conld not see those of the other, and suddenly as be got in the cross-roads he saw the def ndant's car coming at thirty miles an hour, tjn or twenty yards away. To avoid a collision he turned sharply to his left towards Abergele. Bat the other car strnck him with their left wing and foot-board on his off front wheel, timing his car round, so that the front faced Sr George. th" point of impact b-comes a material question in the case, as will be s. en later. Now the! defendant's chauffeur giy, s quite a differentl version of the accident. He says he was coming from the direclion of St Asaph towards Abergeio I at abont twenty miles an hour. When he came to the danger signal, fifty-eight yards from the centre of the cress-roads, he put on his hand-braKe, put the motnr out of geir, and let her run slowly. At the rross-roads he wis going ten to twelve miles an hour. He says he swerved to his off side to clear, put on his foot brake, but he alleges he was stru, li: by plaintiff's car in the centre of his car. He admitted in cmss-txamination he did not sound I his horn until ten yards off the cross-roads, nor did he bear plaintiff's horn sounded A Mr Mortimer, one of the occupants of the car. cor- roboratpd the chauffeur'b story. He says plaintiff's car struck our footboard, he cuiue straight at ns, his radiator ran iot; our foot- board, but I think his near wheel struck ns first.' In cross-examination he said plaintiff came straight bang at us-he did not turn to the left.' Now, if tLc defendant's version of the accident is right one would expert to find the two front whe. Is, but more pattieclarly the near front wheel, and the radiator of his car, damaged. For this reason I adjourned the case for the attendance of the man who repaired plaint'fi's car—a Mr John Pierce. Now, this witness speaks positively as to the impact being at the 'middle part of the front wbe-1 on the right (i.e. the off-side) of plaintiff's car; thr. front right wheel was broken, the spokes being driven in and splintered. The left aide of the car was not touched in any way. The radiator of pLiintiff's car was Dot damHgpd at all. The right-hand side back wheel was also splintered and tyre bnrsted like the front one To my mind this evidence is absolutely conclusive as to what tcok place at the time of the collision. Defendant's chauffeur and the occupant* of his car must be entirely mistaken in their view of the collision. Ther. what caused the accident ? Apart from plaintiff's own evidenct, find that of the other occupants of the car, we have the evidence of two independent witnesses as to plaintiff's horn being sounded and as to the slow rate "f speed he was travelling. In my opinion the acci- dent was due entirely to the fart that defendan's chauffeur neglected the warning given him by the danger signal. He approached cross-roads, with a blind wall on bis left, so that he could not see what was coming across his track, at too great a speed. He did rot blow his horn in time, and when he got to the cross-roads he h id not, owing to his excessive speed, sufficient control c r his car to avoid the accident The items of £ 6 10 in the plaintiff's claim I cannot allow but I giv- judgment for the piairtiff for the amount of his claim. £9 9s 6d less thtt item, viz., f22 1\),; 6d, with costs. Also I give judgment for the plain- tiff Jenkins on the counter-claim, with costs. The plaintiff must pay the costs occasioned by non-production of the witness John Pierce, who repaired the motor. I allow plans, also fee of one surveyor qualifying to give evidence.

Therefore, I think that before the evil spreads it should be nipped in the bud I have have heard rumours of reiigri-tioii from several members if the practice continues. Su ely the members of the Rhyl Bowling Club are sportsmen enough to pity for the love of the game.—Yours truly. The Flintshire County Council, at a specisl meeting on Wednesday, passed unanimously, all the members upstanding, a res lution of condolence with Mrs Pen- nani and the family upon the death of Mr P P Pennant, an alderman of the County Council since its fo-mat-ion and a past chairman. Wedding- Much local interest was evinced on the 26th October, at St. John's Church, Egremont, in the marriage of Mr John Wood, consulting chemist, Poulton Road, S'fnervitif, the second soi of the lafc" Rev John Wood, Vicar of Branstone, Staff), d- shire, and for many years senior curate of St. Cuthbert'a Church, Everton, Liverpool, to Miss Evelyn Roberts, third daughter of Mr Richard Roberts, of Ty Celyn, late of Clan Clwyd, St. Asaph, and niece of Mrs Roberts, of 86 Littledale Road, Seacombe, with whom she has resided for seventeen years.

Denbigh. Motor Acoident Sequel. At the Denbigh County Court on Saturday Judge Moss concluded the hearing of an action brought by Mr H J Howell Evans, solicitor, practising At Denbigh, to recover damages from Dr8 Lloyd and Lewis, of Denbigh, as a result of a motor collision which the plaintiff alleged wits due to the negligence of the defendants' chautieur. Evidence was given that ihe defendants' car, in which Dr Lewis was seated, was proceeding down Vale Street, Denbigh, and at a bend at the bootom of ihe hill it collided with the plaint if, who was cycling to Denbigh. The plaintiff claimed £19 15s 6d damages for personal injuries and injuries to his bicycle, and the defendants counter-claimed £ 3 for damages to the car. His Honour, in giving judgment, said 1 hat he was sat sfied thut defendants' chauffeur had not exercised reasonable e,re in turning the corn r and gave judgment for the plaintiff for £10 10s., and also on the couo ter-claim. North Wales Asylum. A special meeting of the committee ot visitors of the North Wales Asylum was held on Monday at Denbigh. The principal business was the elec- tion of a successor to Dr Llewelyn R Cox, who has resigned the office of medical superintendent, after holding it for 28 years. All the members of the committee were present with one exception. A special committee had opened the applications for the superintendents office and hid prepared the following" short list": Dr. W M Herbert, the senior assistant me lie d officer at th-s Denbigh Asylum. Dr. William Stanley Hughes, senior as- sistant medical otlicer (male side) at the CKybury Asylum, London. Dr. T Bodvel Roberts, assistant medictl officer at Bexley Asylum, London. With- out discussion tho commir.tee proceeded to ballot on the name*, 15 votes being given for Dr. W Stanley Hughes and 12 for Dr. Herbert. The salary attached to Vie ofuce is £ 500 per annum, with house, COAJ, light, and other emoluments. Prestatyn. Whist Drive. The second of a aeries of whiat drives arranged by the Constitutional Club tnok place on Thursday, when another splendid gathering was witnessed. Rhuddlan. Lay Reader's Marriage. The wedding was ri-cently solemnised at Kdvey (Swansea) Pir sh Church of Mr William Wynne (late of Rhuddlan), lay reader, St Peter's Church, Pentrechwyth, and Miss Rebecca Diviee, second daughter of Mr Rhys Davies, builder, Pentre- chwyth. The Rev J G Mithias, vicar, officiated. The bridr, who was given away hy hor father, was gracefully attired in white silk with large picture hat, and was a. tended by Miss Katie Divies (sister). Rev J G Jones (LUnsamlst) acted as beat man. Mr and Mrs W R Davies, Mr" Wynne (mother of the bridegroom), Messrs Val Hum phries and Isaac Thomas were also of the party. The wedding breakfast was partaken of at the Grand Hotel, Swansea, after which Mr and Mrs Wynne left for Tenby, where the hocuymooa was spent. There was a number of nic presents. New Wesleyan ChapEll. Special services were held on Sunday and were continued during the week to mark the op^riine o the above place of worship. The preachers included the Revs Ll. yd Jones, Chester, chairman of the North Wales No 1 District of the Welsh Wesleyans Tlics Hughes, Bangor, an old Rhuddlan boy T 0 Jones (Tiyfau), Rhyl and Francis E Joaes, Pres- ta yn. The budding is a v-;ry neat one and reflects much credit &like on the architect, builden and congregation. Test Concert. The C.M. Lfcture Hall was packed last night, on the occasion of a test concert arrar.g-d by a committee of which Mr W H Jones, Khydydd-tu- ddwr, was the secretary. Mr R Hughes, J.P., Llanfairftchan, presided, and the adjudicators were Messrs Peter Edwards (l'tdr Alaw) and David Owen (D-nbigh). After a very line scries of competitions the results were announced as follows; Ladies' challenge solo, M ra Lees (nee Humphreys), Rhyl. Gentlemen's challenge solo, Mr J Morns Jones, Rhyl. S.dj for competitors who had no', previously won a prize 'n open competition, Mr Wm Jones, Dyserth. Challenge recitation for comp titors over 16 year of age, Mr Eilio, Cerrigvdruidion. Several vocahs s took part in the challenge solo competition, the prize ctiered being a silver cup. After a keen contest Mr G W Joors declared the winner to b» the singer of It was thou the destroyer" (Verdi), Mr Frs-nk Nicholson, Gwespyr, who he said hid q, rich mellow voice and did the piece full justice, his singing throughout being very dramatic. The cup was presented to th,! winner by Mrs Rog -r Price. Tho Chairman, in replying to a vote of thanks proposed by the Rev T M R. ed and seconded by tho Rev Dr A J Parry, congratu- lated all concernrd upon the excellent way in which the fixture had'been carried out. The pro- gramme had been a most erjoyable one throughout. Referring to the performance ^y the Rhyl Juvenile Choir, h" thought bit ns a town they were proud of the choir and of .Mr Wadsworth for the way in which ha h %,I trained it. He very heartily oongratuute;! the choir en the distinction it had gaiaed rot, oulv fr-i- itself and its conductor, but for the town, in its recent succesi at the Colwyn B:y National Eisteddfod.
