E. Broome for assault. Mr J. n. Alianson appeared for the defence. ] L-Vi-ul said he went to the Se.iont to fish on Monday night, and at a. certain spot he went to he saw a rod on the ground. Soon ] after he had commenced fishins Broom-* came there, and said it was his place, and that he (Loveil) should go awav. Lovell re- pjiedi that he had a perfect right to be there, but defendant struck him till he ioll knee-deep into the water.—By Mr Allanson I did not challenge Broome to fight on a previous occasion, nor did I call after him "There goes the champion fisherman." Mr Allanson: Are you not regarded afl a terror of the river?"—I am not more of a 1 terror than anybody else.—For the defence j Mr Allanson said there was no corroboration that any assault had been committed by Broomr- upon complainant. This was not the first t ,r.le that Lovell had brought charges agr.iiist persons who had been river watch- ro". Those charges were dismissed, and he (Mr Allanson) asked the Bench, after hear- ing the defence, to dismiss the case, and not only that, but to order the complainant to pay the costs, inasmuch as he had brought the defendant into Court on a charge in sup- port of which he (Lovell) had no evident Broome gave evidence to the effect that ho was at one time a water bailiff, and since then he had been continually annoyed hv Lovell. On the day in question, witness had fixed his rod on the ground, and wher. he returned to the spot he found Lov'ell standing there and fishing. It was a custom that if an angler had chosen a certain spot and had left his rod there, that he should have tlie first claim to fish ther'e. Lovell knew this well. Broome said he never at- tempted to strike Lovell. who said, "If I had not been bound over in the sum of £10 I would be on top-of you in a few minutes." Broome rl.plied: I know nothing about that. Lovell said: I will bring Tommy down to- morrow night.—Thoma- Evan* and Evan R.. Jones, who were fishing close, by. said thev did not. Me Broo-«e doing anything to Lovell. It was impo?sib'e for him to strike Lovell without them seeing him do so.— The Bench, m dismissing the rns«, ordered Lovell to pay all the costs, including half the advocate's fee.
