lugal, &t. (7672). ORDER OF THE BOARD OF AGRICULTURE AND FISHERIES. (Dated 26th March, 1909.) CARNARVONSHIRE (PARASITIC MANGE) ORDER OF 1909. The Board of Agriculture and Fisheries, by virtue and in exercise of the powers vested in them under the Diseases of Ani- J mals Acts, 1894 to 1903, and of every other power enabling them in this behalf, do order, and it is hereby ordered, as follows: Definition of Parasitic Mange. 1. The expression "parasitic mange" in this Order means sarcoptic mange or psoroptio mange. Separation of Diseased and Suspected Anintals and Notice oj Disease. 2.—(1) Every person having in his pos- session or under his charge a horse, ass, cr mule affected with or suspected of parasitic mange shall (a) as far as practicable keep that animal .separate from animals not so affected or suspected; and (b) with all prac- ticable speed give notice of the fact of the horse, ass, or mule being so affected or sus- pected to a constahle of the police force for the police area in which the horse, ass, or mule so affected or suspected is. (2.) The constable receiving such notice shall forthwith give information of the re- ceipt by him of the notice to an Inspector of the Local Authority, who shall forthwith report the same to The Local Authority. Velerin ary Inquiry by Local A Itthor tfy as to existence of Parasitic Mange. 3.—(1.) The Local Authority on receiving information of the existence, or supposed existence, of parasitic mange shall forthwith cause inquiry to be instituted as to the cor- rectness of such information with the assist- ance and advice of a Veterinary Inspector, or of a veterinary practitioner qualified ac- cording to the Act of 1894 to be a Veterin- ary Inspector- al The owner and occupier of any pre- mises on which there is a horse affected with, or sustpected of, parasitic mange, shall give all reasonable facilities for the inquiry by the Local Authority under this Article, and any person failing to give such facilities shall be deemed guilty of an offence against the Act of 1894. Detention of Animals. 4.—(1.) A Veterinary inspector of the Local Authority may serve a Notice (in the Form A set forth in the Schedule to this Or- der, or to the like effect) on the occupier of any stable, shed, field or other premises in which there is a horse, ass, or mule, which in his opinion is affected with parasitic mange, and thereupon the following restric- tions shall take effect: (i.) The horse, ass, or mule so affected shaH not be moved out of the stable, shed, field or other premises specified in the Notice, except with the written authority, J and under the supervision, of an Inspec- tor of the Local Authority, and only to I. some other place of detention and during the detention it shall from time to time, as often as may be necessary, be treated by the owner thereof with some dressing or other remedy for parasitic mange ap- i proved for that purpose by a Veterinary Inspector of the Local Authority; (ii.) No other hoirse, ass, or mule shall :be moved out of the stable, shed, field, -or other premises, unless on each occasion immediately before the movement it is treated with some dressing or other remedy for parasitic mange approved for that pur- pose by a Veterinary Inspector of the Local Authority. (2.) A Notice under this Order shall re- main in force until it is withdrawn by a Notice in writing served on the occupier of the premises by an Inspector of the Local Authority. Regulations of Local Authority as to Cleansing and Disinfection. 5.—(1.) The Local Authority may, for the purpose of preventing the spreading of par- asitic mange, make Regulations for the fol- lowing purposes, or any of them: (i.) For providing for the cleansing and disinfection of any place used by, and of utensils, mangers, feeding troughs, pens, hurdles, harness, or other things used for or about, any horse, ass, or mule affected with or suspected of parasitic mange: (ii.) For prescribing the mode in which such cleansing and disinfection are to be effected (iii.) For requiring the owner, lessee, or occupier of any such place to cleanse and disinfect any such place, utensils, man- gers, feeding troughs, pens, hurdles, har- ness or other t,hings, at the expense of the Local Authority, or at the expense of such owner, lessee, or occupier: I (iv.) For requiring the removal by the owner from contact with horses, asses, or mules, of litter used for or about any I horse, ass, or mule affected with or sus- pected of parasitic mange. (2.) The mode of disinfection shall be one of those prescribed by the Diseases of Ani- mals (Disinfection) Order of 1906. I (3.) If any person fail to cleanse and dis- infect any place or any utensil, manger, feeding trough, pen, hurdle, harness, or other thing, or to remove any litter, in ac- cordance with any such Regulation, it shall be lawful for the Local Authority, without prejudice to the recovery of any penalty for the infringement of such Regulation, to cause such place or such utensil, manger, feeding trough, pen, hurdle, harness, or other thing, to be cleansed and disinfected, or to remove such litter, and to recover summarily the expenses thereby incurred from such person. (4.) Where the power conferred by the preceding provisions of this Article is exer- cised by the Local Authority, the owner, lessee, or occupier of the place to be cleansed and disinfected ehall give all reasonable faci- lities for that purpose. Provisions as to Regulations of Local Authortiv. 6.—(1.) The Local Authority shall forth- with send to the Board two copies of every Regulation made by them under this Order. (2.) If the Board are satisfied on inquiry, with respect to any Regulation made by the Local Authority under this Order, that the same is for any reason objectionable, and direct the revocation thereof, the same shall thereupon cease to operate. I Extension of certain Sections of Diseases of Animals Act, 1894. 7. Horses, asses and mules shall be ani- mals, and parasitic mange of horses, asses, and mules (in this Order called parasitic mange) shall be a disease for the purposes of this Order and of the following sections of the Act of 1894 (namely) Section forty-three (powers of police); ,Section fortv-four (powers of inspectors) and also for the purposes of all other sec- tions of the said Act contammg provisions relative to or consequent on the provisions of those sections and this Order, including such sections as relate to offences or pro- cedure. Exemptiott of Army Veterinary Service and Veterinary Colleges. 8. Nothing in this Order applies to any liorse, ass, or mule kept in stables of mi i- tary barracks or camps under the care and supervision of the Army Veterinary Service, or in stables of any Veterinary College affiliated to the Royal College of Veterinary Surgeons. Offences. 9.-(1.) If a horse, ass, or mule is moved in contravention of this Order, or of a Notice under this Order, the owner of the horse, ass, or mule, and the person for the time being in charge thereof, and the person causing, directing, or permitting the move- ment, and the consignee or other person re- ceiving or keeping it knowing it to have Jrgal, &t. been moved in contravention as aforesaid, and the occupier of the place from which the horse, ass, or mule is moved, shall, each according to and in respect of his own acts and defaults, be deemed guilty of an offence against the Act of 1894. (2). If anything is omitted to be done as regards cleansing or disinfection in con- travention of this Order, or of any Regula- tion made thereunder, the owner and the lessee and the occupier and the person in charge of any place or thing in or in respect of which the same is omitted, shall, each according to and in re.spect of his own acts and defaults, be deemed guilty of an offence against the Act of 1894. (3.) If any owner, occupier, or person in charge of premises requiring to be cleansed and disinfected fails to give the facilities to a Local Authority required under this Or- der, he shall be deemed guilty of an offence against the Act of 1894. Interpretation, 10. In this Order- "The Board" means the Board of Agricul- ture and Fisheries: "Inspector" includes Veterinary Inspec- tor: "The Act of 1894" means the Diseases of Animals Act, 1894. Extent. 11. This Order extends to the administra- tive county of Carnarvon. f Commencement. 12. This Order shall come into operation on the fifth day of April, nineteen hundred and nine. Short Title. 13. This Order may be cited as the CAR- NARVONSHIRE (PARASITIC MANGE) ORDER OF 1909.
