'1 CORONATION FIREWORKS. AMUSING MISTAKE AT CARDIFF. Grand Theatre Lessee Sued. Judge Addison, K.G., at the Southwark Connty Court on Tuesday heard a claim by James Pain and Sons, pyrotechnists, of Waiworth- road, against Mr E. Quigley, the pro. prietor of the Grand Theatre, Cardiff, for JE5 4s 6d for fireworks supplied. Mr Easton, solicitor, who appeared for the plaintiffs, said the defendant ordered a box of rockets and other fireworks for display on the roof of his theatre on Coronation night. The goods were sentina. champagne cuseas the plain- tiffs had to ua3 all kinds of boxes, and the de- fendant's men,on receiving:it,-pat it into the wtne cellar, thinking it really contained champagne. Some months later the mistake was discovered, and then the defendant wanted to return the goods. The defendant said that as the plaintiffs were giving a display in Sophia Gardens Field, he asked them to send him a box of fireworks with the goods for that exhibition. He received an invoice and presumed the goods would be delivered by | the plaintiffs' men. They did not, as he believed, I turn up, and he forgot alL about the matter nntil i three months later, when another invoice came to band. Then search was made, and the box [ was found in the wine cellar. There were four (bars in the theatre, and his men not having any .notice of what the box contained naturally con- eluded it was champagne, and put ft out of the way." I His Honour I should have thought they would I have put it out of the way in another fashion, being Coronation time. (Laughter.) Continuing, the defendant said a representa- tive from the plaintiffs called and said there would be no trouble about taking the box back, and he accordingly returned it. He heard nothing moire until he received the summons. I Mr Easton said their representative had no authority to say that the box wsuld be accepted back. The goods were still waiting the order of the defendant. His Honour (to the defendant): I am afraid you will have to take the fireworks back. You will have a good opportunity to use them at Christmas when you have your pantomime.. The Defendant 11 don't want them now. They can keen them. Mr Easton A splendid opportunity for using them will present itself on November 5th. The Defendant: They can get rid of them for the 5th. His Honour: When people have once sold goods they have a very great dislike to taking tbem back. There is not enough proof that the traveller was authorised to Bay that the goods could be returned. There must be inderment for the plaintiffs for the amount claimed with sts. Mr EastonHe can have the goods. THE PENARTH WOUNDING CASE. At Penarth Police Court on Wednesday a charge of unlawful wounding was preferred by Nicholas Maschiovello, a Penarth boarding-house keeper and outfitter, against Ferdinando Danenzio, marine fireman, who had latterly lodged at the boarding-house. Prosecutor's evidence was to the effect that as he was leaving his shop pri- soner attempted to strike at his throat. He saw the latter had a razor in his hand and tried to dodge him, but was slashed across the chin. Earlier in the day prisoner had accnsed the witness of getting a job for another man, which he had promised the prisoner. Daniel Cochlin, a fireman, said he saw a razor in prisoner's hand and saw him strike at the pro- secutor, who shouted, Oh, God t" and then ran down Dock-road, prisoner following. It was done so quickly that he did not know the prosecutor was cut. William Kenure, a labourer, of Penarth, said he followed the prisoner, overpowered him, and took the razor from his pocket, finally handing him over to the police. Dr. Hacquoil sai tprOBecutor was cut on the I chin. the wound being about two inches long, and penetrating to the bone. Prisoner, who was committed to take bis trial at the next Assizes, said, in reply to the Bench, if prosecutor had given him the job he would not have done it.

PENARTH WOMAN'S INJURY. Coaltrimmer Acquitted. At Glamorganshire Quarter Sessions on Tues- day, Judge Gwilym Williams presiding, Ben. jamin Sadler, coaltrimmer, of Salop-street, Pen- arth, was charged with doing grievous bodily harm to Annie Drew by kicking her. Mr Arthur ) Lewis (instructed by Mr J. H. Jones) prosecuted, and Mr St. John Francis Williams (instructed by Mr Harold Lloyd) defended. The prosecutrix in her evidence, stated that on the evening of the 6th September she met Sadler in Salop-street, Penarth. He was under the influence of drink, and after using threatening language kicked her in the abdomen several times, causing her in- i'ury which she had not yet recovered from. Evidence was given by a Mrs Hall, P.C. Clinch, and Dr. Barry in support. The prisoner admitted kicking the woman and inflicting the injuries, but said it was an accident. She had dropped a loaf of bread, and in attempting for a lark to kick the loaf accidentally kicked her. Other evidence was called to support this theory, j Whilst Mr Francis Williams was addressing the jury they intimated they had heard enough and stopped the case, and found the prisoner '1 Not c guilty." The jury's decision was greeted with applause,which drew from the Chairman a sharp rebuke.

LITTLE GIRL'S CHARGE. Treorky Engine-Driver Remanded. Thomas Cole, a grey-headed engine-driver, hailing from Treorky, appeared before the Pontypridd Stipendiary on Wednesday charged with having attempted to criminally assault Mary Jane Richards, a girl aged ten, living with her grandmother at 144, Dumfries-street, Treorky, where the defendant lodged. Whilst the girl was giving her evidence Mr G. Stuart Seaton, solicitor, said he had just been instructed to defend, and asked for a remand. This was agreed to, after Dr. Tribe had given evidence to the effect that he found practically no evidence of any assault upon the girl. Bail was allowed, the defendant agreeing to live with his brother, a gardener, at Aberdare, until the hearing at Ystrad next Monday.

SIR THOMAS LIPTON HOME. The Transatlantic Cup. Sir Thomas Lipton arrived at Qaeenaown on Saturday morning on board the White Star liner Cedric from New York. He con- firms the report that he has placed a cup, valued at X-5W, in the hands of the New York Yacht Club, to be sailed for by yachts of any description without time allowance from Sandy Hook to the Needles. A prize valued at R200 will also be given to the second boat. Sir Thomas expects that the Kaiser will enter his yaeht Meteor, and that a number of other well-known boats, including Navahoe, Vigilant, Shamrock III., and Reliance will compete. Sir Thomas believes that the race will stimulate yachting generally. Sir Thomas attribnted the failure of Shamrock Ill. entirely to the superiority of the American- built boat. He was anxious to find the British designer equal to Herrescboff, and he would be his man.

TONYREFAILBOYS ESCAPADE Stole His Stepmother's Rings. Octavius T. Davies, R. Ivor Evans, and D. Pugh, boys from Tonyrefail, appeared at the Ponty- pridd Police Court on Wednesday. Davies was charged with stealing four rings, valued at 115, the property of his stepmother. Emma Davies, and the two others were charged with receiving them. The evidence showed that Davies took the rings, gave three to Evans in return for three pigeons, and one to Pugh foe a small chain. Three of the rings ware produced, but Evans said he had lost the other, which was the most valuable. Davies was ordered to receive six strokes with the birch, Evans was remanded for a week to give him a chance to find the ring, and Pogh was bound over in £ 5 to come up for judg- ment if called upon.

's representative applied for the transfer of the licence of the Pieton Arms beerhouse, Commercial road, from John McMurray to Jacob Goodwin, a young un- married man 22 years of age. Goodwin, who is, of small stature, told the Court that his parents wodd live at the house with him. He had bean in the public-house business with his parents for many years. McMurray said that he had been forced to leave the hoase. There was very little trade done there. Who applicant was given an excellent character, but the justices refused to grant the transfer on the ground that they did not consider the applicant a sufficiently respon- sible person to hold a Imblie-howe licence.

Thomas left his family six weeks ago and went away from Newport, and the family had to seek relief. Thomas, who bad deserted his family on two previous occasions, had allowed his membership of the Union to lapse, and was thus unable to follow his trade at Newport. On the last occasion when he left prison a situation was obtained for him in the North of England, but.on getting there he re- fused to work on the ground that he was offered 4s per week less than was paid to other men in the shop. Thomas was fined 40s or a month's imprisonment.
