SATURDAY, FEBRUARY 15, 189a I NQTES&TcoaiMENTS The negotiations of the Swansea Cor- poration with the Tra.mv.ay Company have produced a perfect tangle. As the un- ravelling must be done by Monday next— unless the Corporation are prepared to pay the Parliamentary fees on the off chanc e of subsequently disposing of the difficulties— it is reasonable-to conclude that the Tram- way Bill is as good as throttled. Air. Martin's narrative of the events j leading up to the present situation brings one point very clearly into view. For] some reason or another a change came over the Tramway Company niter the pr'<"c of the electric power to be supplied aacl been fixed on the 11th December. From that date on, the conduct of the company is that of a body which had become indifferent to the arrangement made or was designedly prolonging the period of negotiation so as to exact com- promises from the Corporation by playing at the eleventh hour upon the evident anxiety cf the members to push tiirough the scheme. uo j other explanation suggests itself, which accounts for the singular silence of the company during the month of January, when communication after communication was left unanswered, and for the nature I of the demands made when i.h?. time available for negotiation had become one ¡ of hours merely. The fuller information made public yesterday tends to deepen the impres- .-ion originally formed respecting the j conduct of the tramway directors. Con- cessions a'ready yielded to them at. the ( point of the bayonet, as it were, may nut represent anything like the alarmist figures of Mr. Richard Watkins. but however favourably diagnosed, it is certain that the amended agreement is a much less favour- '=' able one for the ratepayers than that with which the promoters faced the burgesses at the statutory and other meetings. The desire manifested by the members of the council to save the Bill from wreckage is natural enough, having regard to the work already done and the expense incurred in bringing matters into the final stage. it II is to be hoped, however, that no further concessions will be made to the demands of the tramway directors. In truth, it Im.s already become an arguable question whether, assuming the company accept the Corporation proposals in their present form, the borough interests would not be better served by throwing the whole scheme into the melting-pot. The hint that the running powers over J the Mumbles Railway should be made the subject of a distinct and separate agree- ment is ominous m view of the question- able procedure adopted by the company. It behoves the Corporation to secure a definite understanding capable of standing legal test as to the disposal of these running powers before acquiring property, the market value oi which is largely influenced by them. I Taking all circumstances into account I we comess to a lurking hope that a settlement will not be effected with the Tramway Company, but that the Bill will be abandoned. It would seem as if the Corporation had already been led, step by step, beyond the point originally regarded :>,Q, safe. No other conclusion can be reconciled with the statements made by I the promoters of the scheme when it was submitted to the ratepayers. No provision was made in the estimates of Mr Manville for the purchase of accumulators and transformers, and it was therefore inferred that the Lain way would have to pay for these. Furthermore, the bargain struck with the company for the supply of electric energy was criticised on the understanding that the price fixed was for the article as produced at the central station. Contro- versy raged around the moot point whether electric power could be produced at "i £ d. per unit. Had it been imagined that the price was not for the electri • energy as produced, but a3 supplied ready for use at various depots, the case of the opposition would have been almost unassailable. For it is indisputable that electricity loses practically half its efficiency when trans- formed and stored in the accumulators, so that the Corporation would have to pro- duce for the 1-jd. or 2d., as the ca-e might be, not one but practically two units. The general impr.;>wion left up m the mind after reading the statement of Mr. Martin is that the Tramway Company feels or affects indifference as to the carrying out of the scheme. To what extent the Cor- poration members are. open to ct-usure for their treatment of the n atter hinpen on the degree of binding force possessed by the conditional agreement. If the hitter be good in Jaw, so that it is only necessary to have the clauses interpreted by a judge and jury, they « a-inot be blamed for acting and talking as if they had made a bargain, the terms of which could not bo materially altered. But thev must surfer in prestige if it should be discovered that while talking of an agree> .<• it, no such docu- j 1 t l' ment existed as understood in law. i II Should the abandonment of the Tram-) way Bill become necessary, a* seems likely, it is to be hoped that no hasty decision will be arrived at in respect of the other parts of the triple scheme. Breathing time should bo taken. Hypothetical time should bo taken. Hypothetical II demands for electric energy from the I Mumbles Juilway or the Harbour Trust should not induce a leap to be taken in the dark. In any event, the Mumbles Ratiway would not be a large consumer, and special reasons exist which render it improbable I that terms advantageous to the railway company and the public could be arranged. If tin; Tramway Bid collapses, the lesson thereby enforced will be that it is the duty of the Corporation to g") slow and on well-defined bas^s. —
