Usk and Pontypool Highway District. ELECTION OF CLERK. THE HIGHWAY BOARD of the above District will, at their next. Meeting, to be held on FRIDAY, the 12th of May, 1865, at 2 p.m., proceed to the Election of CLERK to the said Board. The Salary will be £ 20 per annum, and the duties as laid down and defined by the "Highway Act, 1862," and the Highway Act. 1804. A mes- sentjer ot the court said ))lainuff was unable to appear, as he nad been taken into custody, at the instane-' ot his master, to answer a charge 01 deserting service at Trelleck Petty Sessions that day. The case vtus therefore adjourned. John Harris v. Henry Bird.-Clllim £1 12s. 6d.—This case had been adjourned tor the production of an old book. winch wall now produced by Mr. Powell, of the fircu of Jones and Powell, U,k, to whom piaintiff had assigned bishehts. His H>>nor inquired it the person who made the entries was present, and upon being told she was not he said tile case must be again adjourned, at plaintiff's expense, lor her attendance, as the entries cou d not be taken as evidence, onlv as refreshing her memory. John Sullivan v. Thomas Andrews.—Plaintiff, a laborer resi ling at Raglan, claimed 6s. 9d. of de eudaut, a shop- keeper, of the same place, as balance on seven sacks of potatoes Defendant said lie had only had six sacks, and that he had supplied plaintiff with goods to the amount ot £ 1 NIOS. 9|d., which lett a balance of 2^ I only. 2, 2 Amongst the items for goods was one of Is. for jjroceries, supplied to another woman at the request of plaintiff's wife, which His Honor disallowed, and gave judgment for ls. 2d., to be paid in a week. John Watkins v. David Rogers.-This was an action to recover t7 l"s., the amount of a bill of exchange, at two months, dated April 23. 1863. Plaintiff's account of tha transaction was that he bought two mows ot hay, which had been jurlgpd as 14 tons, of defendant, (jiving him a bill at two months for £27 10s. in payment, but Sotting that the hay only held out 10 tons, he went to defendant, and the latter gave him the bill in question to make good the deficiency. Defendant- denied that the hay was short in weight, and said hi- gave the bill merely as an accom- modation for plaint,ff woo came to him a day two before his bill (which had been discounted at Bailey's bank) became due, saying that he had only £20 to meet it with. His Honor, in giving judgment, said the law presumed that when a person gjve an acceptance he littd some consideration tor it, and tuerefore, on the evidence before him (the parties being equally respectable in his eyes) he could not do other than give judgment for the amount. Thomas Watkins v. Charles Walkey.—Mr. Partridge appeared for defendant, who is a clergyman resin,ng at Llanti-issent, near Usk. Plaintiff claiined 95 6s. 4i. for washing household linen and clotning, at ttie rale of Is. per dozen. A;2 8s. 9d and 4s. costs had been paid into court. It appeared that plaintiff was formerly in the service of defendant as groom, and rented a n t age under him that at the time ot entering the service an agree- ment [put in] was drawn up be ween the parlies, which stated, amongst other tilings, that, plaintiff's wife was to have the washing of the faoity at a certain sum per quar- ter to be tixed upon. Plaintiff's wife said the under- standing was thai the sum should not be fixed upon until defendant had provided a suitable stove and o'.her con- veniences tor ttie washing, but as he had not done so the usual rate of ls. per dozen had been charged, waich, she added, was a very moderate price, consi ering that the only appliances she had were a small cottage Ere and a saucepan. Louisa Walkey, wife ot defendant, on being sworn, stated tisat a verbal arrangement was made before the agreement was signed, by which plaintitl's wiie undertook the asliiiig at 1:3 10s. for the first quarter, and if that was found to be not sufficient she was to have more 'or the future; she continued to do the washing on tint understanding for eight or rune weeks, and then refused to do any more; the proportion of. the quarter had been paid into court; there was nothing said about charging by the dozen; witness promised to provide a stove, but it was not part of the contract.
