Mr. Glyn, a Sl'licitor in Gray s-inn. said he saw the defendant walking quie'lv away, and the prosecutor came brliiud him and kicked him twice maliciously on the shin. The defendant then hecame abusive, wli<-reiip"Ti the sergeant threw him violently against some railings, fie did not remonstrate with the policeman, because on a former similar occasion a friend of his wa-. taken into c.istodv and charged with attempted rcucnc. The »eigcant admitted shoving the defendant, whom the magis'rafe discharged, while remarking tliar this practice of "shoving" on the part of the police caused half the rows in which the force after- wards became engaged, and he requested the inspector to convey hia opinion on this subject to the proper authorities.

SAD STOIJV OF THE SEA. The Transatlantic steamer Frisia, of Hamburg which arrived at New York on the 22:id of last month, landed there three men whom she had rescued from the Spanish schooner Joannina, belonging to Barcelona, which vessel, it appe-irs. left St. Domingo on the 22nd June last, bound for Havre with a cargo of wood. On the 28th of June the first mate wag suddenly taken ill, and died in about an hour a little later four others were attacked in a similar manner, and expired in less lhan 24 hour*, when their bodies were consigned to the deep. The captain, one able seaman, and a passenger named Gauthier. were now the only hands left on board the vessel, and they were in a moBt exhausted condition when on the 45th day out they were fallen in with by the Frisia. The poor fel- lows had then been without food fcurdtv. From the account of the survivors, the cause of the deaths of their comrades is not. really known their symptoms were, however, something of the description of cholera morbus. The schooner was abandoned.

—— -> Friday, September 15th. Before the Mayor (John Watking, Beq,), Jolm piftvics, Philip Williams, Isaac Morgan, J. W. Szlumper, asd John ltees, Esqrs. ALLEGED FRAUD BY MR. BALCOMBB. John Barton Balcombe was charged on remand with having wilfully made certain false entries in the books of the Bronfloyd Company with intent to defrand. Mr. J. B. Porter prosecuted, and Prof. Palmer defended. Prof. Palmer resumed his address, and then' called the following evidence, after a, long discussion had taken place between connsel as to the truth of the abstract at accounts put in on the previous day. Henry Henley Ferguson said he was a School Board officer at Liverpool, and was formerly clerk to Mr. Balcombe, from Nov. 1868 to Midsummer. 1871. He kwpt Mr. Balcombe's books, and those of both the Bronfloyd companies. He remembered the vol- untary winding-up of the 1861 company. He made a fair copy for the printers of the articles of the asso- ciation of the new company. The book produced was the printed book referred to. The article No. 7 referred to the creation of new capital. That capital consisted of 20,000 shares of 50s. each, and a premium of 30s. upon 20*0, making an aggregate of JJ4. The capital raised amounted to .645.000, consisting of 18.000 shares at 50s. each free for the purchase of the estate of the old company. The 2000 additional shares were issued at Y,4 per share, ie., at 30s. premium. The^e shares were taken up by the original allottees, with few exceptions. He subsequently entered such allotment in the journal and ledger of the company. The entries in the ledger produced were in his handwriting- -on page 5. He prepared the balance-sheet for Dec. 31st, 1870. The < £ 8,000 was credited in full in that balance-sheet. By article 7 tl-osn to whom the shares were allotted had ihe right of paying for their shares of £4 each by eight equal instalments of 10s. each, with interest. When he left Mr. Balcombe's employment in 1871 four of those instalments were still due. arrears alsoexistin"- in respect of those that had already fallen due. The witness was not cross-examined, and at this stage the court adjourned for an hour. The hearing was resumed in the afternoon, and the case was then remanded until this (Saturday) morn- ing at 11 o'clock.
