THE FATAL TRAMWAY ACtilDBNr Af CAhDIFF. Aninouest was hfld yesterday morning (before Mr. Belli'), in the Cardiff Infirmary, touohing the ,th of an Irish labourer, named William Dfiaooll, who rtct ivtd fatal it juries on MonJ iy last, by oue of the cars belonging to the Cardiff iramwAy Com. pany. The deceased died from the effect of the il juries en Thursday. Mr. ELBor watchtd tho case on behalf of the coal- pany. Tho principal witness examined wag Mr, Smitb, an inspector in the employ of the company. He stated that the deceased was intoxicated, and got 011 to the front of the car near the driver. It was about three o'clock in the afternoon. He (witness) told him to get oonn, and he refused, saying his money was as good as anyone else's. Ho then c( mmenced mounting the steps to get on to the top of the car, when he caught hold of the decease's band and told him the car was full. The decoised then stepped back instead of forwards, and fell do*a nenr the wheels. One of his legs got entangle 1 iu the wbeel, and the flesh was fearfully lacerated and torn from the bone from the foot to the knee. Ho was immediately conveyed to the infirmary. The wife cf the deceased stated that Bhe weaH in a position to prove that the last witne's pushed her husband off the oar, in consequence of whioh he met with his death. That statement has, however, been contradicted by Smith, who appears to think that it would have been better for the deceased had he been pushed off, as be would then have probably cleared the car. 1\8 ;hed:thbeV!i unW Monday atfour o'clock for further evidence.
, - - , I SERIOUS CHARGE AGAINST…
SERIOUS CHARGE AGAINST A SWANSEA MA KINK STORE DliALKR. On Tbnreday (before the Stipendiary and Mr. Brock), William Donne, an extensive marine-store dealer, carrying on business in Swansea, was charged with having purchased a painter's square and saw, the property of Benjamiu Pegler, painter. Air Clifton appeared for the defenoe. Mr. Clifton, before the evidence was prooeeded with, made a preliminary protest against the grossest W,itb ?,ity which ch?acteriaed the present pro- cee?ingt. The defendant had very recently bew a witness in that court against a woman who had been committed for trial, mainly on his eviaenoe, on the charge of stealing the very tools whioh he was now charged with purchasing, well knowing them to have been stolen. Beoause the defendant bad, in giving his evidenoe on behalf of the prosecu- tion, and made certain admissions which he had done, his evidence, which was what might be termed II Queen's evidence," was to be used that day against him, and he was called that day to answer a criminal charge bantu upon it. Such a coarse was, he sub- mitted, unprecedented, and he bad never daring the whole oonrse of his experience known of suob an irregularity. The defendant, before giving his evidence, bad not been cantioned that be was not bound to criminate himself, and that the admissions he happened to make might be used in evidenco against him. If this case were proceeded with, he might deem it necessary to apply for a certiorari in the superior courts. Mr. Fowler atked the learned advocate whether be meant to contend that a man giving evidence in a case which tended to criminate himself was thereby not liable to a prosecution in case there was ground to believe that he was guiity of a criminal offence. Mr. Clitton replied that the lata recorder of Bristol bad on one occasion ordered a witness into custody to be prosecuted, in couecquoacj of oortaiu statements he made in examination. The matter was represented to Government, and the gentleman referred to was no longer recorder of Brijtol. Tae case was taken to the Superior Court, and at once quashed. He (Mr. Clifton) urged that the court bad 110 power to put the defendant on his trial, in :¡¡:Stedhtm?;bfibaa when giving 8,iden08 for the Q%oen. He was pro- tected from the rebutto of what he might have said there. The proceedings taken were of a moot extraordinary eharaoter, and he must at this stage protest against it. The court, after some consultation, ordered the evidence to be proceeded with. The prosecutor then deposed to having called at defendant's shop after having lost the property from an uninhabited house in Convent street. He left his card there. The saw produced contained his name engraved in full on it, and the smara had his WMSi le1 Ihs hi an wW was in ieftndauVi shop said ifcty could not purchase tools. The tools aiterwards hung up for sale outside the shop. He called on some other marine store dealers, and left them his cards. The Stipendiary, after hearing further eviaenoe, intimated that rnder the whole circumBtanoea the bench had decided to dismissed the ease; but they took the present opportunity of oautioning all marine store dealers against purchasing goods so oarelessly as had been done in this instance, otherwise they mijiht render themselves amenable to be prose- cuted.

CARDIFF. I SHIPPING Caseb.—At the polioo-oourt, yester- day (before Messrs. R. 0. Jones, H. Bowen (Mayor), G. Bird, and J. Pride), Daniel Sullivan, a sailor, was charged with deserting his ship, called the Upab, of Newcastle. The articles were signed in London by the prisoner, and the ship proceeded to Cardiff, where he deserted. The defenoa was that the prisoner went on shore to buy some olothes, and got a little drop too much." The case was dismiBBea, &8 me eviuonoo uiu UUit DU.UDu.a IfU, (harge of desertion. David Nolan was oharged with neglccting to proceed to sea after signing articles, In the Marina, of LiverpooL The prisoner joined the ship in Livsrpool for a voyage to Rio de Janeiro, via Cardiff. At the last-named port the prisoner neglected to go on board, and was appre- bended at the Sailors' Home. The prisoner said he did not go to his vessel because the authorities at the Sailers' Home had refused to give up his clothes. From tho evidence of the deputy superintendent of the home, it appeared that the prisoner's clothes had been detained by him (witness) as security for the debt contracted by the prisoner while waiting for the ship in Cardiff. The magistrates were of opinion that they could not send the prisoner to gaol on the evidence, and the case was dismissed. ALLIIOiD Fraud BY A Sailob.—James Colly, a sailor, was charged with unlawfully obtaining a chest belonging to Charles Hemming from the cloak-room of the GrJst Western Railway Station, with intent to defraud, on Wednesday laat, The sailor Hemming left his chest, containing his clothes, at the Great Was. tern Railway Station, and as he had been taken into custody for striking bis mate, he gava the ticket for one chest to a Bailor named Cymer to get it out far him. Cymer gavo the ticket to the pri- soner to take to the prosecutor at the police station, but the pri@oner, instead of doing o, presented the ticket at the station, and applied lor the chest, 5"" tbat the owner was likely to have three .o.t,?, pr?'.oumot, and he would take oare of the chest for him. He was then given into oustody by the porter in charge of the room. The prisoner, in defence, Baid that he applied for the chest to take core of it for Hemming. He was oammitted to take his trial at the next quarter sessions at Swansea. Knockino A Woman Down.—Henry Bird, a young man described as a labourer, wu charged with :tri:ilrd:od (I:ar:J'E1::n Bowden living in David-street, an Thursday evening. The prosecutrix had a very serious bruise on one of her eyes, whinh she stated had been caused by the prisoner striking her. The case was fully substan- tiated against the prisonsr. and he was sent to gaol for fourteen days' hard Sabonr. Assaulting tub Pglick,—Edward Lewis, a horse dealer, was charged with assaulting Polios- constable AHeraan (17) on Wednesday, the 23rd ult. Mr. Blellooh appeared for the defendant. The oonstable taw the defendant in the Westgate- hotel at ten minut6s to eleven o'clock at night, and requested him to leave, as he was making a great noise there. He refused, and the policeman put his band on the shoulder of a man named Talbot, who knocked him down twice. Talbot had been fined for assaulting tho constable, and from the evidenoe then adduced it came out that the defendant Lewis bad struck the constable. Mr. Mosley said: On tho cioht of the Mth ult? there was ? row outaide ste Hotel, uIh"thewdef"e;dat o: was the ohief actor in the row. He inoitsd the mob to ridicule the police, He (witnMe) did not see ijjc do :t!:fO\es:s uso hm tg::tv: freely and cause an obstruction by not moving on when told to do so. The defendant was also charged with causing an obstruction. The magistrates said the evidence did not warrant theui in going further into the charge of assault, Witnesses were oalled, who proved that the defendant did not cause an obstruction, and he was dismissed with the caution that he was to be more careful next time.
