DURY. f The hewing of tho above action was commencod on Wednosduy morning in tho Otioncery Division of the High Court of Justice (before Mr. Justice Kekewloh), Mr. Warmington, Q.C., M,P. Mr. Hadley, and Mr. Upjohn uppearing for the pluintiff, and Mr. Byrne, Q.O., and Mr. It. 11. Norton repre- senting the defendant. Mr. Wararitigtou, in opening the case, said the action was one brought by the plaintiff, Mrs. Phillips, who lived with her husband at the Cam. brian Public-houso, Tredegar, Monmouthshire, to enforce a deed of compromise entered Into with the defendant, Bird. Dury, who resides at Trehnrris, and which was dated the 16th of August, 1888. The facts were, said the learned counsel, somewhat peculiar. There was an old gentleman, named Jaines Hawkins, who lived in Tredegar, and who wus possessod of a considerable property, amounting to something between Eg,000 and Z10,000, but who residad nlune. The plaintiff, tvoily Phillips, was Mr. Hawkins's cousin, and the defendant, Mrs. Dury, Will also it cousin. In March, 1886, Mr. Hawkins gave instructions for tlie preparation of a deed of gift of the wholu of liii property to the plaintiff, who hud been on intimate and affec- tionate teruis with him. This deed was dated the 26th of Murch, 1886. At tiiis time the testator or, perhaps, he had better refer to him in future as the deceased—was living at 12, Market-street, i'redegur, quite close to the plaintiff's premises, and was a frequent visitor there, but in the month of May, 188B, he went on a visit to Mrlt. Dury, who wutl liviug at Tteharris. While he was slaying with Mrs. Dury he executed a testamentary instrument on the 271h of July, 1886, leaving all his freehold and leasehold pioperty to that lady. Mr. Hawkins died shortly afterwards, nawely, ou the 1st of August, 1886. As goou as these events canlo to tho plaintiff's ears she consulted her solicitor, intoruied him of the deed of gift to her, and instructed him to enter a caveat aguiudt the proof of the will in Mts, Durj's favour. A considerable portion of the deceased's property was in the shape of money, which was lodged with the London uud Provincial Hank at Tredegar. On the 9th of August, 1886, u de- mand was tuade on behulf of the plaintiff by her solicitor, Mr. Dauncey, on the solicitors wlio repre- sented the defendant, Messrs. James, of Merthyr, for the delivery up of all documents couuocted wiUI the testator's or deceased's estate then in the possession of Mrs. Dury. Subse- quently a deed of compromise was executed by Mrll, Phillips und fits. Dury in the piesencuof Mr. Jiitiies UlJd Mr. Spencer, a locum teneru acting for Mr. D tuticey, who' was taking his holidays, it wtis this deed, dated the 16th of August, 1838, that the plaiutiff now sought to en- force. The defendant's case was that the deed of compromise was obtained by fraud, uud on the understanding that the plaintiff had a valid deed ot gift.datod ptior to the will in favour of Airs. Dury. The defebdout further put in a counter- claim to lavo the deed given up to be cancelled. Mr. J. C. Juuies, a member of tho lirui of G. ttnd C. Jituics, solicitors, of Mei tbyr, wus then called un behalf of the plaintiff, and examined to show that tho defendant at the interview when the deed of comptouiise was executed seemed most determined that the matter should be settled in that way in order to avoid the expenses of a Illw- suit. Other evidence having been called, the^urtber bearing of thu case was adjourned.

Lewis and Sons, at Gorseinon Tinplate nnd Mottach Vitriol Works, and by Mr. Aaron Stone, of Penyfedw Farm, being riparian owners of portions of land abutting on tlie Rivers Llan and Lliw, and the brpok Blaenunt Ddu, from which the town reservoirs are supplied. By virtue of the Swansea Local Board Act of 1860 the defendants were authorised to construct and maintain certain waterworks and reservoirs on the River Lliw aad the Blaenant Ddu Brook, but were bound to cause to flow duily out of the reservoirs minimum volumes of watar—-down the River Lliw not loss than 640 gallons a minute, and down the Blaenant Ddu Brook not less than 224 gallons a minute during the whole day of twenty-four hours. Failure to supply such minimum quantities of water rendered the defen- dants liable to penalties of 15 per day, together with nuy damage sustained by the riparian owners. For a period of 135 days (from the 24th of May to the 5th of October, 1887), the delen- dants failed to supply such minimum volumes of water. and in consequence the plaintiffs, Lewis and Sons, were entirely unable to conduct their works. They now claimed as a penalty for the River Lliw, 1675, a simuar sum for the Blaenant Ddu Brook, and JE500 damages, making a total of £ 1,850. In their pleadings the defendants admitted that the minimum quantity of water, as specified, did not flow, but argued that it was not owing to any negligence on their part, but entirely to the act ot God, the season being one of exceptional dryness. They denied that the plaintiffs suffered any damage, or that the penalties in the actiou could be sustained. They held that only one penalty of ib per day could be imposed, and added that other actions, in which a similar penalty was claimed, were still pending. Mr. Scone's action was of a similar character, though be did not claim compensation, and laid the period for penalty from the 9th of May to the 4th of October, or a period of 148^days. Mr. M'Inlyre, Q.C., and Mr. Abel Thomas (in- structed by Mr. C, P. Charles for Mr. Stone, and by Messrs. Richards and Jones for Messrs. Lewis; were for the plitintiffe, and Mr. R. T. Reid, Q.C., M.P., and Mr. David Lewis (instructed by the town-cleric of Swansea) for the defendants. In opening the case, Mr. M'lntyre, Q.C., said that before the year 1860 the inhabitants of Swansea were supplied with watqr from reservoirs which occupied the site of the present Sketty Lake. The authority, which was at that limo a Loc:il Board, contemplated several schouies of wntor supply, but they had to bo abandoned, and in 1860 all Act of Parliament was obtuiued authorising the defen- dants to construct reservoirs in the Lliw and the Bluenaut DduValloy, through which flowed two well- defined streams, the Lliw and the Blaenant Ddu. At the bottom of the vulluys these streams joined and formed one river, whlen was called the Lliw. The plaintiff Sione's works were situated above, whilst the plaintiff Lewis's works were below, the junction. By the Act, however, the defendants were made to stipulate to send down the River Lllw a minimum flow of water of not less than 640 gallons a minute, and down the lllaenanti Ddu stream not less than 224 gallons a minute duriug the whole day of 24 houts otherwise to render themselves liable to II penalty of 15 per (Iuy if the water did not How, and any damages tho riparian owners might sustain. By the Act of 1884, however, the penalty was iiioditied to L5 per day, and it was under that Act that the plaintiffs now claimed, The learned counsel contended that the Act of 1860 did not entitle the defendants to receive the whole of the water, and that they were bound to send down the stipulated minimum volumes to the riparian proprietors, who, before the construction ot the reservoirs, had the exclusive right of the whole supply, Mr. It T, Ueid, Q.C., for the deltiuce, gave therea- sons why the failure in the supply ensued. From 1867 to 1873, hu remarked, the Lliw Reservoir did its duty without any cause ot complaint. In the latter year, however, alter exceptional weather, a leak of a very formidable churucter was dis- covered, the innor covering being forced through the outride covering by a spring..Thereupon the Blaenaut Ddu Reservoir was commenced and com- picled, and SfteL wards ttie Lli w Reservoir was re- paired. Those repairs were effectual uutil 1883, when, however, another leak of a similar character, and very near the place of the tirst leak, was discovered. Tho defendants then obtained another Act of Parliament, which empowered them to con- struct another reservoir, which was now nearly completed. In their present crippled stuto the cor- poration had ouly a storage capacity of 230,000,000 gallons of water. Last year's severe uud unparalleled drought made it impossible for the cotporation to supply both the general inhabitants of the towu aDd the com- pensation wallir. Whatever, therefore, might be the legal aspect of the case, tlio defendants chose rather to ruu the risk of being made the target of all those who desired to sue them for a penalty of 1:5 a duy, than to render the town liable to pestilence und disease. The proseut supply even was much stinted. In conclusion the leurned counsel con- tended that the failure to supply the compensation water was not owing to any negligence on the part of the datendante, but to all inevitable acci- dent, coupled with the Act of God. Mr. John Thomas, town-clerk of Swansea, said that tho estimated population of the borough was 76,000. At the present time there were nine writs against the corporation for penalties and damages for the non-supply of compensation water. Mr. John Thomas, keeper of the Lliw Resetvoir, and Mr. James Morris, keeper of the Blaenant Ddu lleservoir, produced books showing the vain- fall and inflowing and outflowing returns during last year. Mr. Edward Cousins, C.E., formerly waterworks engineer to the defendant corporation, confirmed the evidence he gave at a previous hearing of the case at Swansea last year. He testified that, the materials and the mode of construction of the Lliw Reservoir were alike excellent. Mr. Wyrill, the present waterworks engineer, said that subsequent experience led him to considerably modify a previously ex- pressed opiniou that the materials used in the construction of tho Lliw Reservoir wero not of the best. He deposed that the raiufall in the first nine months of 1887 totalled 17 29, us against 2640—the average rainfall for tho twenty years previous. The compensation water was supplied until May 9, when lie advised the corporation that it t;hould be discontinued. Tlie water then stored amounted to 20,600,000. The total supply from iiittural sources to both reservoirs between May 9 and October 5 was 75,035,840 gallon. which with the total stored Oil the 9th of May would give a storage of 95,635,840 gallons, but of that he estimated that 161 millions evaporated. The daily consumption averaged 2,280,000 gallons. The supply was entirely inadequate to meet the requirements of tho town. Mr. Reid: It is true, I believe, that water was sold in the streets, is it not ? Witness I don't think so. The Judge: That is, then, another romnnce for which we tire indebted to the Press. (Laughter.) Sir Robert ltawlinson, the well-known civil engineer, was next examined. He also confirmed his previous evidence, and added that the reservoir in 1860 was constructed in the best possible man- ner then known. The leak in 1873 wos preceded by very extraordinary weather, which he believed developed such small fissures its previously existed. Alter Sir Robert had been examined, Mr. Reid intimated that his case then closed. His Lordship stated that he would deliver judg- ment in London next Tuesday. On Saturday last counsel for plaintiffs received a cheque for the whole of the balance of the claim, and it only now remained for him to make out his claiui for the purpose of deciding the matter of costs,—After a long legal argument his Honour gave judgment for plaintiffs, with costs. Matthews AND Lewis.—This was an action brought by the plaintiff, Arthur Mattliews,to recover X53 18, 2d, wages due to him from the defendants,William Lewis and John Rees Matthews, colliery proprietors, Moesycw miner, Mr. Clement Higgins and Mr. C. J. Jackson (instructed by Mr. John Jones) appeared for the plaintiff, and Mr. Abel Thomas for the defendants. Plaintiff was employed as a collier by the defendants, one of whom (Matthews) ia his uncle, and with whom he lodged during the time he was employed at the colliery. It was urged by the defence that the supplying of the board and lodging was a settlement of the claim, and that therefore he was no longer entitled to recover.
