Blaenau Ffestiniog County Court. STAY OF EXECUTION. On Thursday, before His Honour Judge William Evans, Mr. Proctor, (instructed by Messrs Lloyd George and George), applied on behalf of the liquidator, Mr S. C. Hughes, Brymbo, for stay of execution in connect- ion with the case heard at the last Court, when His Honour gave judgment for £ 40 damages against the Provident Co-operative Society, Blaenau Ffes- tiniog, in respect to injuries to a son of Mr Evan Stoddart, who was run down by a trap belonging to the Society. The plaintiff duly issued execution to enforce the judgment. Afterwards the Society went into voluntary liquidation, and the present application was made with a view to the creditors of the Society generally having an equal division of the assets. The liabilities were estimated at £ "730 and the shortage at £536. Mr R. O. Davies, who appeared for Mr E. Stod- dart, offered strong opposition, remarking that it was not a bona fide liquidation and was made to defeat the judgment in the running down cost. S. C. Hughes, who gave evidence, stated in reply to the Judge that the position of the Society was worse now than it was two years ago, and then it was insolvent. His Honour How much ? Mr Hughes: Possibly about a £ 100. His Honour: That won't do. Have you any figures ?-No, sir. After considerable argument between counsel and Mr. R. O. Davies, his honour upheld the argu- ment of Mr Davies and refused the application. A VOCALIST'S CLAIM. J. T. Owen, A.R.C.M, of Blaenau Ffestiniog, sued Lewis Davies, secretary to the Royal Oak- eley Silver Band, for £ 19s, in respect of railway and hotel expenses during an eight days tour with the band in South Wales in August last. Mr R. (). Davies, for the plaintiff, said he was a musician of some distinction. The agreement come to by correspondence was that Mr Owen who was to sing at each concert, was to be paid £$, plus railway and accomodation expenses. The £ 5 was duly paid, but the committee refused to pay the bill for expenses. His hotel charges were at the rate of 10s a dav, a night when he stayed with a friend being omitted. Mr Proctor (instructed by Messrs Lloyd George & George) who appeared for the defendant, said the charges of the plaintiff were considered excess- ive. The expenses of the members of the band were only 325 each. Mr Davies remarked that it was the most paltry defence he had yet heard. The Judge said that up to the present he was also of the view that it was a frivolous defence, and he was inclined to refer it to the Registrar. Mr Davies asked that the case should be dealt with by His Honour that day. The Judge consented and evidence was given by Mr J. T. Owen, who said he was away for eight days entirely on the business of the band, and he would be out of pocket even had his bill been paid. Cross-examined He did not see that he would gain much in advertisement by the tour. When asked whether during the tour Mr Lewis Davies did not come to him and say that the committee resented his staying at the best hotel, plaintiff, said "yes," and that he was staying where he would stay under ordinary circumstances. Asked if he had not requested to be engaged for the Watchnight concert of the band. plaintiff replied that this was an infamous, bare-faced lie. Evidence was then given by the defendantr Lewis Davies, to the effect that the committee con- sidered the charges excessive. He admitted that they had agreed to pay accomodation expenses, but never thought he w( uld send such a heavy bill. The Judge held that the claim was not exorbit- ant and gave judgment for the full amount with- costs. ACTION OVER A PRIZE HEN. Owen Roberts, Wynn's Road, Blaenau Ffestiniog, sued the Cambrian Railway. Company fur £2 2s the value of a prize hen which lie alleged was lost in transit on the Cambrian Railways between Pwll- heli and Minffordd. Mr R. O. Davies appeared for the plaintiff, and Mr Jones Morris for the defendant company. For the defence it was contended that the person put in charge of the hen was not a railway official, and judgment was entered for the Company with costs.
