The report of the Watch Committee was read, and ordered to he confirmed. The report of the Finance Committee was read, when Sir Thomas Phillips moved, and Mr. Jones seconded, the following Tcsoiution :—" That the proceedings of the Finance Committee 'be confirmed, except so much thereof as recommends the trans- fer of the corporation rents to the general account of the Coun- cil, but that such transfer be not made at present." This reso iuLion was carried unanimously. It was then moved by Sir Thomas Phillips, seconded by Mr. and carried unanimously,—"That the opinion given by the Attorney-General, on the case laid before him, with re- spect to the corporation rents, having been real., to the board,— Resolved, That the Town Clerk be authorised to produce such case and opinion, for the inspection of any committee ap- pointed by the burgesses of the borough, during the current month and that public notice of this resolution be given. [OPINION (IF Tin: ATTOIINUY C; I'M. It A I,.] Having considered the facts and documents submitted to me in this fa-jc, with the arguments on both sides, I am of opinion, that the ithote of tho rants now in dispute must be applied by the Town Coun- -cil, under the !)2nd section of the Municipal Corporation Act. It seems t» me, that nothing turns upon the power of the Mayor and Aldermen, muder the old system, to manage the Corporation property, or to make ^bye-laws. This was property belonging to the old Corporation; and if -the freemen had had a right to assist in the management of it, if it /had not been applied to their particular benefit, it is now applicable to ■public purposes, and the rents go to the credit of the borough fund. When the Municipal Corporation Act passed, there was neither sta- ;tute, charter, bye-law, or custom, by which the freemen could have ,collected those rents, and applied them to their own particular benefit. I aw, therefore, of opinion, that no part of these rents can be law- fully divided among the freemen; and that the freemen must be con- rtenfc>d with the profits of the Marshes, to which they, under the second section of the Act, have an indefeasible title. The creditors of the Corporation, having obtained judgment, will Tiave the usual remedies against the property of the Corporation, real and personal. J. CAMPBELL. Temple, October 20th, 1839. It was then resolved, that Mr. Latch and Mr. Morrison be added to the Finance Committee. It was moved by Sir Thomas Phillips, seconded by Mr. Iggulden, and carried unanimously,—" That the Finance Com- mittee be requested to meet on an early day, and report to the Council the amount of claims on the Corporation, which are < hnrgeabte on the rents. And further, that they examine into, and report generally on, the present state of the Coiporation property." Sir Thomas Phillips moved the following resolution, which was seconded by Mr. Morrison, and carried That the pre- sent police force of the borough is inadequate to the preaerva- wron of the public peace, and the security of persons and pro- perty, Within the borough and that it be referred to the Watch Committee, to take immediate measures to make the police force effectual for the purposes for which it has been esta- blished." It w-t-, moved by Mr. Iggulden, seconded by Sir Thomas Phillips, and earned,—" That, in the opinion of this Council, the public convenience would be greatly consulted by the transfer to the Council of the duties now performed by the Town Commissioners, and that they be respectfully requested to adopt such proceedings as may be necessary to transfer to the Council the powers now vested in them and that the Town Clerk be requested to nitend the next meeting of the Commis- sioners, and then communicate to them the present resolution."
